Service Area Office, East Department of Veterans Affairs 323 North Shore Drive, Suite 500 Pittsburgh, PA 15212AUGUST 3, 2010 Attachment A: Request for Sole Source Memo Format DEPARTMENT OF VETERANS AFFAIRS Justification and Approval For Other Than Full and Open Competition 1.Contracting Activity : Department of Veterans Affairs, VISN 08, 0573 Medical Center Justification for Other Than Full and Open Competition VA 2237 Request Number- 548-11-4-1016-0223 2.Nature and/or Description of the Action Being Processed: This is a request for other than full and open competition for the procurement of a software upgrade to the currently owned Alcon Infinity Machine. 3.Description of Supplies/Services Req4ired to Meet the Agency's, Needs: The Alcon Infinity machine is used exclusively for Ophthalmology service within the operating room. The upgrade in software will enable this machine to accommodate Vitrectomy type surgical procedures within the Operating room and make it function exactly like the newer, second Alcon Infinity machine that was purchased that came with this upgrade already installed. 4.Statutory Authority Permitting Other than Full and Open Competition: (x ) (1) Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements per FAR 6.302-1; ( ) (2) Unusual and Compelling Urgency per FAR 6.302-2; ( ) (3) Industrial Mobilization, Engineering, Developmental or Research Capability or Expert Services per FAR 6.302-3; ( ) (4) International Agreement per FAR 6.302-4 ( ) (5) Authorized or Required by Statute FAR 6.302-5; ( ) (6) National Security per FAR 6.302-6; ( ) (7) Public Interest per FAR 6.302-7; 5.Demonstration that the Contractor's Unique qualifications or Nature of the Acquisition Requires the Use of the Authority Cited Above (applicability of authority): This software upgrade is required to make this Alcon Infinity machine compatible with existing supplies and instrumentation currently used within the operating room and allow for use when the service is using two rooms simultaneously and performing similar type of retinal procedures. This software is used on our cataract surgery patients where there is a need to cut vitreous gel that may present through or around the posterior capsule, vitreous traction raises the incidence of complications including retinal detachment and endophthalmitis. Proper management of this requires a rapid cut-rate on the vitrector, and we have this capability on our newest infinity machine. This software upgrade is required to properly perform cataract surgery on our patients and "ALCON LABORATORIES, INC." is the "Sole Manufacturer" and distributer of the "Infinity Ultravit Pneumatic Upgrade Product and no other company can provide it. 6.Description of Efforts Made to ensure that offers are solicited from as many potential sources as deemed practicable: Alcon is the "Sole Vendor" with proprietary rights and only vendor capable of upgrading their own equipment, no other business can provide service on their product 7.Determination by the Contracting Officer that the Anticipated cost to the Government will be Fair and Reasonable: Updating existing equipment represents a better value to the Government rather than procuring an entire new system. 8.Description of the Market Research Conducted and the Results, or a Statement of the Reasons Market Research Was Not Conducted: ALCON LABORATORIES, INC. is the sole manufacturer of this equipment and own proprietary rights. 9.Any Other facts Supporting the Use of Other than Full and Open Competition: "Alcon"is sole vendor capable of upgrading their own equipment.
