Description
The National Institute of Standards and Technology (NIST) intends to negotiate, on a sole source basis, under authority of FAR 6.302-1, with East Coast Metrology, LLC, of Topsfield, Massachusetts, for the acquisition of Metrology Services to Align Neutron Guides to be used in the NIST Center for Neutron Research (NCNR) at NIST, Gaithersburg, Maryland. *** NIST cites FAR 6.302-1(a)(ii)(A) and (B) (see excerpt below) as primary rationale for Sole Source Determination. (ii) Supplies may be deemed to be available only from the original source in the case of a follow-on contract for the continued development or production of a major system or highly specialized equipment, including major components thereof, when it is likely that award to any other source would result in -- (A) Substantial duplication of cost to the Government that is not expected to be recovered through competition, or (B) Unacceptable delays in fulfilling the agency's requirements. (See 10 U.S.C. 2304(d)(1)(B) or 41 U.S.C. 253 (d)(1)(B).) Sole source determination is based on the need for a vendor which has intimate knowledge of the NCNR application and the expertise required for a successful installation in the time period required. The personnel at East Coast Metrology have been involved in the expansion occurring at the NCNR from the start in terms of guide alignment. Part of the expansion at the NCNR involves the installation of 5 new guide lines. To achieve this, East Coast Metrology has reviewed facility drawings and then designed a high accuracy laser tracker control network to be used for aligning the five new neutron guide lines. These new guide lines will pass through the existing confinement building (Rm C-100), then through a smaller room (Rm D-100) and finally into the expanded guide hall (Rm G-100). After designing the control network, East Coast Metrology has technically assisted the NCNR with the onsite control network setup in all three rooms. This includes instrument measurement operations and control network analyses. In fact, East Coast Metrology, LLC is still currently working with the NCNR under contract number SB134110SE104 to complete the deliverables that are part of that contract (this effort will be added to the existing contract via a negotiated, Firm-Fixed Price, bilateral modification). After this work is done, the control network will be used for aligning all of the components needed for successfully installing the 5 new neutron guides in rooms C-100, D-100 and G-100. This includes aligning the neutron guides themselves, aligning the vacuum jackets that the guides sit within, and aligning other important components of the system such as the guide shutters, and the parts needed for going through the concrete walls in between rooms, the shielding, etc. If another vendor were selected to do the required work, it would take at least one month for them to learn about and understand the current NCNR application. This would be redundant effort. The NCNR is in the midst of a shutdown for 10.5 months (the shutdown started on April 3rd, 2011) so that the expansion (eg the installation of the 5 new guide lines and more) can occur and extending the shutdown is not a viable option due to additional cost that would be incurred in a delay. East Coast Metrology, LLC is the only known vendor capable of supplying the required service within the schedule required by the NCNR. *****The North American Industry Classification System (NAICS) code for this acquisition is 541330, and the size standard is $4.5M. ******A determination by the Government not to compete the proposed acquisition based upon responses to this notice is solely within the discretion of the Government. Information received will normally be considered solely for the purpose of determining whether to conduct a competitive procurement. *****No solicitation package will be issued. This notice of intent is not a request for competitive quotations. However, responses received by August 8, 2011 will be considered by the Government.
