Description
This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in FAR Subpart 12.6 as supplemented with additional information in this notice. This announcement constitutes the ONLY solicitation and no other solicitation document will be issued. This solicitation is issued as a Request For Quote number HSCG44-11-Q-PCI066. This number is for tracking purposes only. Solicitation documents and incorporated provisions and clauses are those in effect through Federal Acquisition Circular 05-53. This procurement will be processed in accordance with FAR Part 12 and 13. The North American Industry Classification System (NAICS) is 511210. The SBA size standard is $25.0 MIL. Due to this Acquisition being considered to be a Sole Source it is not anticipated that the Contracting Officer will receive 2 or more Offers from qualified Small Business Concerns; therefore IAW FAR 19.502-2(a) This IS NOT A Small Business Set-A-Side. Due to the compatibility and parts/logistical support of existing USCG Systems & Components it is required that the Software is to be manufactured/created by Aware Incorporated. Only. Substitute proposed Manufactured/Created Software will NOT be considered for award. Requirement is for 10 each of: AWARE NISTPack Workstation Runtime License and 10 each of: AWARE NITSPack Workstation Runtime License, One Year Maintenance. The USCG C3CEN intends to purchase on a non-competitive basis with AWARE INC.. The proposed contract action resulting from this synopsis/solicitation for commercial supplies is the Governments intention to solicit and negotiate with only one source under the authority of FAR 6.302-1 & 13.106-1(b). Interested persons/parties may identify their interest and capability to respond to the requirement or submit proposals. This notice of intent is not a request for competitive quotations/proposals. However, all quotations/proposals received within 5 days after date of publication of this synopsis/solicitation will be considered by the Government. A determination by the Government not to compete with this proposed contract based upon responses to this notice is solely within the discretion of the Government. Information received will normally be considered solely for the purpose of determining whether to conduct a competitive procurement, and for informational purposes for future acquisitions. The contractor for this proposed Sole Source contract is: AWARE INC. Cage Code: 3NGJ8. An EPLS/CCR/BINCS Contractor Verification Information search was conducted on Jul/19/2011; by the Contracting Officer listed below, the Contractor is Active in CCR and appears to be in Good Standing with the Government and is not on the EPLS list. The Coast Guard does not own nor can they obtain specifications, drawings, plans or other technical data for these items. Request for drawings/specs and other requested information will be disregarded. Items are to be New items. Used or Refurbished items are not acceptable. Due to the compatibility and parts/logistical support of existing USCG Systems & Components it is required that the items are to be OEM Specific. Substitute proposed Brands/Manufactured will NOT be considered for award. Any Offerors that are authorized AWARE INC. Distributors are encouraged to provide a Firm Fixed Price Quotation IRT this Fed-Biz-Ops Solicitation. The government intends to award a contract resulting from this solicitation to the responsible bidder proposal conforming to the solicitation which will be most advantageous and Best Value to the Government, price and other factors considered. The Required Delivery Date is 30 Days ARO. Unless otherwise stated all items will be required to be shipped to the USCG C3CEN Ports. In accordance with FAR 4.1201 prospective contractors are required to submit annual representations and certifications via the Online Representations and Certifications Application (ORCA) at http://orca.bpn.gov. Please ensure completion prior to submission of your quote. Also note that paragraph (b) of FAR 52.204-8, applies. Justification for Other Than Full And Open Competition (JOTFOC) Pursuant to the requirement of the Competition in Contracting Act (CICA) as implemented by FAR Subpart 6.3, HSAR 3006.3, HSAM 3006.3, HSAM, CGAP 1206.3, and in accordance with (IAW) requirements of FAR 6.303-1, the justification for the use of the statutory authority under FAR Subpart 6.302-1 is justified by the following facts and rationale require under FAR 6.303-2 as follows: (a) Each justification shall contain sufficient facts and rationale to justify the use of the specific authority cited. As a minimum, each justification shall include the following information: (1) Identification of the agency and the contracting activity, and specific identification of the document as a "Justification for other than full and open competition." USCG C3CEN in support of the Biometrics At-Sea System (BASS). (2) Nature and/or description of the action being approved. The purchase of the AWARE NISTPack Biometrics' Software is required to match the configuration to the current biometrics system that is deployed throughout the seventh district of the USCG. AWARE NISTPack has been used by the USCG since 2007 and has proven to be a reliable technology operating in the maritime environment. (3) A description of the supplies or services required to meet the agency's needs The AWARE NISTPack Biometrics' Software. NISTPack is a complete suite of Software Development tools that enables law enforcement agencies, systems integrators, and solution providers to generate, view, edit, and print data objects and transactions in compliance with the ANSI/NIST ITL-1 2007 standard. The device aligns with existing training and standard operating procedures already developed as part of the Biometrics At-Sea program (BASS). 10 each of the Software Licenses 10 each of the One Yr Warranty/Maint Package Total Estimated Value: $14,000.00 (4) An identification of the statutory authority permitting other than full and open competition. 6.302-1 (2)(ii) Supplies may be deemed to be available only from the original source in the case of a follow-on contract for the continued development or production of a major system or highly specialized equipment, including major components there, of, when it is likely that award to any other source would result in a substantial duplication of cost to the Government (5) A demonstration that the proposed contractor's unique qualifications or the nature of the acquisition requires use of the authority cited. Aware is a leading Technology and Software Supplier for the Telecommunications and Biometrics Industries. Aware is a veteran of the Biometrics Industry, providing software that targets existing and emerging biometric market opportunities for the Government, evaluated by the USCG to support Biometrics At-Sea System missions. (6) A description of efforts made to ensure that offers are solicited from as many potential sources as is practicable, including whether a notice was or will be publicized as required by Subpart 5.2 and, if not, which exception under 5.202 applies. - Requirement shall be posted on FED BIZ OPS with a statement that any offerors that can provide the exact items as described may provide a Quote and all Quotes will be considered by the Government. (7) A determination by the contracting officer that the anticipated cost to the Government will be fair and reasonable. Prices offered by AWARE Inc. are anticipated to the same or less that the General Public would pay for same items and to be in line with past procurements. (8) A description of the market research conducted (see Part 10) and the results or a statement of the reason market research was not conducted. Procuring from Mfg of equipment. This is a follow-on contract to upgrade equipment. At the time of the original equipment, the base-line was determined. The competition was accomplished at that time. (9) Any other facts supporting the use of other than full and open competition, such as: (i) Explanation of why technical data packages, specifications, engineering descriptions, statements of work, or purchase descriptions suitable for full and open competition have not been developed or are not available. N/A (ii) When 6.302-1 is cited for follow-on acquisitions as described in 6.302-1(a)(2)(ii), an estimate of the cost to the Government that would be duplicated and how the estimate was derived. $500,000.00. Estimated in testing/approvals and configuration cost and IT engineering cost. (iii) When 6.302-2 is cited, data, estimated cost, or other rationale as to the extent and nature of the harm to the Government. (10) A listing of the sources, if any, that expressed, in writing, an interest in the acquisition. None at this time (11) A statement of the actions, if any, the agency may take to remove or overcome any barriers to competition before any subsequent acquisition for the supplies or services required. N/A (12) Contracting officer certification that the justification is accurate and complete to the best of the contracting officer's knowledge and belief. (b) Each justification shall include evidence that any supporting data that is the responsibility of technical or requirements personnel (e.g., verifying the Government's minimum needs or schedule requirements or other rationale for other than full and open competition) and which form a basis for the justification have been certified as complete and accurate by the technical or requirements personnel.
