Description
LIMITED SOURCES JUSTIFICATION 1.Contracting Activity: Department of Veterans Affairs (VA) Center for Acquisition Innovation (001AL-A1-1) 810 Vermont Avenue, NW Washington, DC 20420 2. Nature of Action Being Approved: This Justification and Approval sets forth the facts and requests approval to issue a contract for Workers' Compensation (WC) and Occupational Safety and Health (OSH) Interdisciplinary Training for WC Staff, Supervisors and OSH Professionals Department-wide with the Chesapeake Health Education Program, Inc., (CHEP) Bldg. 82H 1st Floor Perry Point, MD 21902. The estimated dollar value for the 1 years is $620,000 with an option for 2 years not to exceed $2M total. 3. Description of Services and Supplies: The proposed contract performance is for one year from date of contract award, plus two one-year options. This contract will provide interdisciplinary training for more than 1,600 VA employees. The contractor shall provide course materials developed over the course of 12-years of hosting the Annual government-wide Federal WC Conference. 4. Authority: This procurement is conducted in accordance with FAR 8.405-6(a)(1)(i)(B), Only one source is capable of providing the supplies or services required at the level of quality required because the services are unique. No other supplies or services will satisfy agency requirements. 5. Rationale Supporting Use of Authority Cited Above: Chesapeake Health Education Program (CHEP) is a non-profit organization. A Memorandum of Understanding (MOU) and a Revocable License between the Corporation and the VA Maryland Health Care System (VAMHCS) allows a close but separate working relationship with the Department of Veterans Affairs to accomplish staff education and the sharing of educational resources. CHEP has been providing this type training for VA and many other Federal agencies for more than a decade. CHEP is the only entity that is capable of providing accredited courses on WC and OSH for those who require continuing education credits. Furthermore, CHEP is the only entity with the resources to provide existing WC and OSH curriculum pertinent to VA WC and OSH staff, thus eliminating the need to 'reinvent the wheel' on a large number of the WC Best Practices course curriculum. 6. Market Research: A broad market survey was conducted for this requirement. Several vendors were contacted which included six vendors from the GSA Schedule for conference planning. A questionnaire outlining the criteria, required to successfully accomplish the project within the short time period directed. Only CHEP was able to provide a response that indicated its fully-capable status with the emphasis on the need for accredited training for federal personnel. All other responses indicated that the responding company was not capable of fulfilling the complete needs of the contract. 7. Determination of Fair and Reasonable Cost: The Contracting Officer will determine the price to be fair and reasonable by using historical costs paid for this type of service. 9. Additional Support: This training is essential and required to develop the specific skill sets within the VA for the WC and OSH staff to effectively manage the VA WC and OSH Program; returning partially disabled employees to productive employment; reducing accidents and injuries; reducing the number of Occupational Safety and Health Act (OSHA) citations and reducing unnecessary program costs under the statutory authority of the Federal Employees Compensation Act (FECA). These objectives are specifically ordered for all Federal agencies under the Presidential Directive entitled Protecting Our Workers and Ensuring Reemployment (POWER) Initiative, Executive Order 13548 and Office of Personnel Management (OPM) Directive to all Federal Agencies entitled OPM Model Strategies for Hiring People with Disabilities. 10. Other Interested Sources: As stated herein, there are no other known sources that could provide the accredited interdisciplinary training requirements from the perspective of demonstrated ability, existing curriculum availability, production, and project assessment. 11. Future Competitive Plans: The Government will continue to survey the market for future requirements to increase competition.
