- Sole Source J&A Special Notice Information Solicitation: AG-3144-S-11-DK01 Agency/Office: Office of Procurement and Property Management Location: Procurement Operations Division - ITS Title: Notice of Intent to Sole Source OPNET Technologies, Inc. Description(s): Notice of intent to award sole source procurement under the Simplified Acquisition Procedures (FAR 13) and Other Than Full and Open Competition (FAR 6.302-1). This notice is for information only; a solicitation will not be issued. THIS IS NOT A REQUEST FOR QUOTATION. No contract will be awarded on the basis of offers received in response to this notice. The associated North American Industry Classification System (NAICS) code is 541511, Custom Computer Programming Services with a size standard of $25.0. In accordance with FAR 6.302-1, the Government intends to negotiate a sole source contract OPNET Technologies for the purchase of software licenses and maintenance to include upgrades for new releases, patch levels, software enhancements and technical support for three (3) each of the following existing platforms: IT Guru, ACE Analyst Module, ACE Decode Module, eXpress Data Import, Server Specialized Model License, NetDoctor Module, Flow Analysis Module, Advanced ACE Capabilities Module and the System Performance Module for HP Openview Technical Support Agreement. Period of Performance is 29 July 2011 thru 28 July 2014. The Government believes OPNET Technologies, Inc. is the only source that will satisfy the agency requirements. The Government is contracting for these software licenses and maintenance solutions from OPNET Technologies, Inc. which is the only known source. This notice of intent is not a request for competitive quotes; however, any firm that believes that it can meet the specifications above may give written notification to the Contracting Officer. All inquiries and concerns must be addressed in writing to USDA ITS Contracting Branch, ATTN: Danielle Knipper, 2150 Centre Ave., Bldg. A, Ste. 145, Fort Collins, CO 80526 or sent by email to danielle.knipper@ftc.usda.gov. Responses to this notice must be submitted by the date/time listed on the notice. Interested sources may identify their interest and capability to respond to the requirement. Any response to this notice must show clear and convincing evidence that competition would be advantageous to the Government in future procurements. Responses received will be evaluated; however a determination by the Government not to compete the proposed procurement based upon responses to this notice is solely within the discretion of the Government. The Government anticipates an award date on or before 25 July 2011. Response to this synopsis is not required.
