- PLEASE READ THIS NOTICE CAREFULLY AS IT CONSTITUTES THE ONLY NOTICE THAT WILL BE ISSUED. This pre-solicitation notice is being issued in accordance with FAR Part 5.204. This procurement is being conducted in accordance with FAR Part 15. The Department of the Interior, Bureau of Ocean Energy Management, Regulation and Enforcement (BOEMRE), intends to competitively award a contract entitled Identify Information Needs and Data Gaps on the Effects to Fish, Fisheries and Invertebrates in the U.S. Atlantic and Arctic from Sound-Generating Activities by the Energy Industry. The BOEMRE Procurement Operations Branch is the contracting office for this procurement and the resultant contract administration. All vendors must be registered in the Central Contractor Registration (www.ccr.gov) in order to receive Government contracts. The Government intends to award a firm-fixed-price type contract for the effort described herein but may consider other proposed types if determined appropriate. The applicable NAICS Code is 541990, All Other Professional, Scientific, and Technical Services, and the work is multi-disciplinary. The period of performance of the resultant contract is anticipated to be not more than 18 months. BACKGROUND: The Outer Continental Shelf Lands Act (OCSLA), as amended by the Energy Policy Act of 2005, and supporting regulations necessitate the collection of information needed to assess impacts from activities authorized by BOEMRE. This includes an analysis of effects to fish, fisheries and invertebrates (that are commercially and recreationally important, threatened or endangered, or keystone species) from sound-producing activities. There are also several other environmental statutes which require BOEMRE to consider carefully the potential impacts to these resources, such as the Magnuson-Stevens Fishery Conservation and Management Act (MSFCMA), the Endangered Species Act (ESA) and the National Environmental Policy Act (NEPA). Oil and gas exploration, sand and gravel resource assessment, future offshore wind turbine placement, and other renewable energy projects will include noise-producing operations (e.g., seismic exploration, pile driving, drilling, vessel noise) and any potential impacts from these activities on fish, fisheries and invertebrates must be analyzed under these respective statutes. Biological impacts and impacts to commercial and recreational fisheries in both U.S. Atlantic and Arctic waters from anthropogenic noise have been identified by BOEMRE as important topics needing additional information. There are gaps in the available information regarding the effects of BOEMRE-regulated sound-producing activities on fish, fisheries and invertebrates which make it difficult to evaluate impacts. BOEMRE proposes to sponsor a workshop to gather relevant experts and stakeholders to identify data gaps and discuss scientific approaches for addressing these gaps. The products of this effort will be a literature synthesis, a meeting report, and a data gap analysis. The results of this workshop will be used to better inform BOEMRE and other regulatory agencies in their decision-making and environmental analysis processes evaluating oil, gas and mineral production as well as renewable energy and alternate use on the U.S. Outer Continental Shelf (OCS). This workshop also will serve in developing avenues of communication and collaborative relationships with experts on fish, fisheries, invertebrates and acoustics from other Federal agencies, affected State and local groups, industry, as well as representatives from other countries. SCOPE OF WORK: The study is expected to: (1) Identify and prioritize data and knowledge needs across disciplines and geographic areas with respect to OCS energy and minerals issues and the effects of sound on fish, fisheries and invertebrates in the U.S. Atlantic and Arctic oceans; (2) Discuss the effectiveness of the various scientific research methods and approaches which might be used in addressing knowledge gaps; (3) Foster collaboration among federal and state agencies, industry (both energy and commercial fisheries), academia, and representatives from other countries, in addressing these information needs; and (4) Produce a literature synthesis, a meeting report and a data gap analysis.
