- Description
- This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in FAR Subpart 12.6. The United States Patent and Trademark Office (USPTO) plans to award a commercial item purchase order for software licenses for NGSSQuirrel Suite utilizing simplified acquisition procedures. Award will be made to the Offeror whose quote is technically acceptable and lowest priced. To be technically acceptable, due to the proprietary nature of the manufacturer's software, the Offeror has to be able to provide the manufacturer part numbers for the products listed in the below specifications and be either the manufacturer or be one of the manufacturer's officially authorized software resellers to the government and be qualified to receive award of the commercial item purchase order as a result of this requirement. This procurement is a 100% small business set-aside. Any questions pertaining to manufacturer part numbers or authorized reseller status should be directed to the manufacturer's point of contact, Jim Taylor at Jim.Taylor@ngssecure.com. All qualified vendors should submit a price proposal for the items listed in the below specifications under the following terms and conditions and shall also provide their DUNS number. Item Qty Description 0001 2 Software License NGSSQuirrel Suite (Oracle & SQL) 0002 2 Software License NGSSQLCrack This announcement constitutes the RFQ and is the only solicitation that will be issued. This solicitation incorporates all of the applicable provisions of FAR clause 52.212-1. Offerors must include a completed copy of the provision at 52.212-3, OFFEROR REPRESENTATIONS AND CERTIFICATIONS - COMMERCIAL ITEMS, with its offer or state that it has completed representations and certifications on the Online Representations and Certifications Application (ORCA) and that these representations and certifications are still valid. The successful offeror will be awarded a firm fixed price commercial item contract for the above requirement using simplified procedures. The commercial item contract will contain the terms and conditions of FAR clause 52.212-4 CONTRACT TERMS AND CONDITIONS and the applicable terms and conditions of FAR clause 52.212-5, CONTRACT TERMS AND CONDITIONS REQUIRED TO IMPLEMENT STATUTES OR EXECUTIVE ORDERS - COMMERCIAL ITEMS. In addition, the following Section 508 requirements apply to this acquisition: (1) 36 CFR part 1194.21 Software applications and operating systems, (2) 36 CFR part 1194.22 Web-based internet and intranet information and application, (3) 36 CFR part 1194.41 Information, documentation, and support documentation requirements and (4) the following clause will appear in the resulting contract "Section 508 Compliance - In accordance with Section 508, the USPTO requires that all Electronic Information Technology ("EIT"), as that term is defined at FAR §2.101, delivered under the purchase order comply with the applicable EIT accessibility standards issued by the Architectural and Transportation Barriers Compliance Board set forth at 36 CFR part 1194". Brand Name Justification: The aforementioned software is required to enable the USPTO to position itself to successfully pass its OIG audits. Any qualified vendor wishing to propose on the above requirement should submit an electronic, firm fixed price quote, responsive to the requirements of this combined synopsis/solicitation, to the Patent and Trademark Office, Office of Procurement, via E-Mail to Chris.Hannah@USPTO.GOV no later than 9:00 A.M.
