Description
VA-69D-11-RQ-1161 The Great Lakes Acquisition Center (GLAC) in Milwaukee, WI intends to negotiate on a sole source basis (IAW FAR 13) with Metro Medical Equipment & Supply of St. Louis, Missouri as the only distribution source that provides The OPMI Lumera 700 ophthalmic OR microscope used for patient care. Carl Zeiss Meditec is the only company that makes a microscope that meets our requirement and that is compatible with current equipment at Hines. Specifically, the contractor shall provide the following: - OPMI Lumera 700 ophthalmic OR microscope with all associated equipment and supplies (Part #00000L7041776227, Quantity 1); This acquisition is being conducted under simplified acquisition procedures (IAW FAR 13). There are no set-aside restrictions for this requirement. The intended procurement will be classified under North American Industry Classification System (NAICS) 334510 with a Small Business Size Standard of 500 employees. This notice of intent is not a request for competitive proposals and no solicitation document exists for this requirement. However, parties interested in responding to this notice will need to submit technical data sufficient to determine capability in providing the same product. All capability statements received within 5 days after publication of this synopsis will be considered by the Government. A determination by the Government not to compete based on responses to this notice is solely within the discretion of the Government. Information received will normally be considered solely for the purpose of determining whether to conduct a competitive procurement. Capability statements shall be submitted by email only as a MS Word or Adobe PDF attachment to Scott Ivy at scott.ivy@va.gov Statements are due by 12:00 CST 13 July 2011. No phone calls accepted. JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION Sole Source for an OPMI Lumera 700, for Hines VA VA-69D-11-RQ-1036 DEPARTMENT OF VETERANS AFFAIRS Justification and Approval For Other Than Full and Open Competition 1.Contracting Activity: Department of Veterans Affairs, VISN 12, Great Lakes Acquisition Center, 5000 W. National Avenue, Milwaukee, WI 53295. 2. Nature and/or Description of the Action Being Processed: Justification and approval for Other Than Full and Open Competition for the purchase of one (1) OPMI Lumera 700 ophthalmic OR microscope for the Edward Hines VA Hospital in Hines, IL per Purchase Request# 578-11-3-969-0168. Award of a new firm-fixed price contract is anticipated. This procurement will proceed on a sole source basis with Metro Medical Equipment and Supply, Inc. 3. Description of Supplies/Services Required to Meet the Agency's Needs: The Edward Hines VA Hospital has a requirement for one (1) OPMI Lumera 700 ophthalmic OR microscope, stock #00000L7041776227, along with add-on equipment. The total for the system is $186,539.40. Delivery is expected within 90 days of the Notice of Award. 4. Statutory Authority Permitting Other than Full and Open Competition: FAR 6.302-1(a)(2). The VA's minimum needs can only be satisfied by unique supplies or services available from only one source (41 USC 253 (c)(1)). 5. Demonstration that the Contractor's Unique Qualifications or Nature of the Acquisition Requires the Use of the Authority Cited Above (applicability of authority): The OPMI Lumera 700 ophthalmic OR microscope is the only product that has the following unique features: (1) both Xenon and Halogen Light sources; (2) patented stereo coaxial illumination for preferred red reflex illumination; and (3) ability to have independent focus for teaching/assistant scope. In addition, the BIOM attachment we have for performing retina surgery is specifically designed to fit on this scope. Furthermore, this is a backup scope for our current Zeiss Lumera scope. Obtaining a different scope would be cost ineffective in requiring separate parts and servicing from different vendors. This request is as a sole source with Zeiss through Metro Medical which is a sole source vendor for this product. The VA needs to be able to do the following: The purpose of an ophthalmic surgical microscope is to provide the best visualization of the eye for performing cataract and retina intraocular surgery. The Zeiss Lumera 700 is by far the best scope for this purpose. 6. Description of Efforts Made to ensure that offers are solicited from as many potential sources as deemed practicable: Other vendor's products were evaluated but did not have all the required features. 7. Determination by the Contracting Officer that the Anticipated Cost to the Government will be Fair and Reasonable: The same items were purchased 6 times on FBO at comparable prices. 8. Description of the Market Research Conducted and the Results, or a Statement of the Reasons Market Research Was Not Conducted: Dr. Pearlman reviewed the different ophthalmic microscopes available. When we purchased our current Zeiss Lumera scope we had perofmed an extensive demonstration of both the Zeiss and Leica microscopes and the Zeiss scope was viewed to be the have the best optics and features compared to its leading competitor (and by extension to any other competitor on the market). There is no question that purchase of the Zeiss Lumera is essential to provide the best patient outcomes for intraocular surgery. A review of scopes on the internet also did not reveal any comparable brand able to perform to the requirements. 9. Any Other Facts Supporting the Use of Other than Full and Open Competition: intends to award a sole source award to Metro Medical Supply for the purchase of an OPMI Lumera 700 Ophthalmology Floorstand Microscope. Carl Zeiss Meditec is the sole manufacturer and distributor of the Humphrey/Zeiss line of ophthalmic and surgical products. The Zeiss/Humphrey line of ophthalmic diagnostic products is sold through direct sales representatives with geographic territory alignments. Sales to the US federal government are sold through a contractual agreement with metro Medical Supply of St. Louis, Missouri. 10. Listing of Sources that Expressed, in Writing, an Interest in the Acquisition: None. 11. A Statement of the Actions, if any, the Agency May Take to Remove or Overcome any Barriers to Competition before Making subsequent acquisitions for the supplies or services required: None. 12.
