JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION HUBZone Program CONTRACTOR - MICAH Group 1. Agency and Contracting Activity Identification: VA Medical Center, Lexington, Kentucky, VISN 9 will enter into a contract that requires justification for other than full and open competition. 2. Nature and/or Description of the Action Being Approved: A firm fixed-price contract is contemplated for Project No. 596A-09-103, Replace AHU's 5, 6 & 7 at the VA Medical Center, Cooper Drive Division, Lexington, Kentucky 3. Description of Supplies or Services Required to Meet the Agency's Needs: Contractor shall furnish all labor, tools, materials and expertise to complete project "Replace Air Handling Units (AHU's) 5, 6 & 7 at the VA Medical Center, Cooper Drive Division, Lexington, Kentucky in strict accordance with the specifications and drawings. Cost Range is $2,000,000.00 to $5,000,000.00. 4. Statutory Authority Permitting Other Than Full and Open Competition: The service is being procured under the authority of 15 U.S.C. 547a, Sole Source Awards under the HUBZone Act of 1997 and 15 U.S.C. 631, HUBZone Act. 5. The Demonstration that the Proposed Contractor's Unique Qualifications or the Nature of the Acquisition Requires Use of the Authority Cited: MICAH Group, a locally owned HUBZone Small Business has self-performed replace of HVAC components including air handlers, pumps, fans and motors, etc. MICAH Group has performed such work at other Government agencies; thus is familiar with working with the Government. The project is well suited for the type of work they do. 6. A Description of Efforts Made to Ensure That Offers from as Many Potential Sources as Practicable and Whether a Notice Will Be Publicized: This procurement was originally solicited as a SDVOSB competitive bid in Fiscal Year 2010. All bids exceeded the Government estimate as well as the low bidder alleged a Mistake in Bid. The procurement was approved to be cancelled and proceed with a Sources Sought for 8(a) and/or HUBZone Contractors. Six responses were received and a determination was made to request to negotiate sole source with MICAH Group, who fulfilled all the documentation required for the determination. Approval was received to go forward with the sole source procurement with MICAH Group. 7. Anticipated Cost: The cost of the construction is anticipated to be fair and reasonable to the Government. An IGE was prepared by Engineering, which will be utilized in any negotiations with the Contractor. The Architect Engineer who designed the project will also be utilized in preparing for the negotiations. 8. A Description of the Market Conducted: A Sources Sought was advertised on FedBizOps for interested 8(a) and/or HUBZone Contractors to submit evidence of bonding capacity, key personnel experience in replacement of Air Handling Units, past performance information and evidence of SBA certification as an 8(a) or HUBZone Contractor. Six responses were received; two Contractors did not submit any supporting documentation or provide the requested information; two 8(a) and two HUBZone Contractors supporting documentation were reviewed by the Contracting Officer and two Engineers. Two of the businesses did not have the appropriate bonding capacity to fulfill an obligation for this project; one did not show the expertise in Air Handling Units; and one did not show performance of a project the size of this project. Appropriate checks were made by the Contracting Officer in CCR, DnB, LEIE, etc. Appropriate past performance checks were made by the Engineers. 9. Any Other Facts Supporting the Use of Other Than Full and Open Competition: In accordance with FAR 19.1306a, the Contracting Officer may award contracts to HUBZone Small business concerns on a sole source basis before considering small business set-asides provided that none of the exclusions listed in (1) through (6) apply. It is the determination of the Contracting Officer that MICAH Group meets all the criteria. 10. Any Other Interest in the Acquisition: No other interest has been shown in this acquisition outside of the six responses received from the FedBizOps Sources Sought. 11. A Statement of the Actions, if any, the Agency May Take to Remove or Overcome Any Barriers to Competition Before Any Subsequent Acquisition is Required: This Contracting Office supports competition on the majority of procurements; however, this procurement had already been competitively bid SDVOSB and exceeded the Governments estimate. Approval was received to cancel the bid and negotiate sole source with the MICAH Group. 12. Contracting Officers Certification.
