Description

DEPARTMENT OF VETERANS AFFAIRS Justification and Approval For Other Than Full and Open Competition 1.Contracting Organization: Department of Veterans Affairs, VISN 7, Carl Vinson VAMC, Dublin, GA. 2.Description of Action: This is a request for other than full and open competition (sole source) for the procurement of a full service preventative maintenance, four inspections, parts, and software upgrades for Aperio technologies.Inspections will include cleaning, lubrication, functional test and leakage tests. Aperio is propriety manfacture and no third party sources warranted to service. 3.Description of Supplies or Services: The vendor shall provide all parts repair services, labor and travel necessary to perform maintenance on Aperio equipment and software upgrades. The parts used must be original parts. Once all parts and software upgrades are install a full operational check must be performed before returning equipment to services 4.Statutory Authority: ( X) (I) Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements; ( ) (2) Unusual and Compelling Urgency; ( ) (3) Industrial Mobilization, Engineering, Developmental or Research Capability, or Expert Services; ( ) (4) International Agreement ( ) (5) Authorized or Required by Statute; ( ) (6) National Security; or ( ) (7) Public Interest 5.Validity of Use of Statutory Authority: Due to the complexity of the software and equipment used, the manufacture is the only source that can replace Aperio equipment. 6.Actions to Promote Competition: No new Aperio trained technicians are available through a third party source to perfoim the required maintenance on the Aperio system. 7.Determination of Fair and Reasonable Price: Per FAR 6.3 03-2(a)(7)(9)(ii) that the anticipate cost to the Government will be fair and reasonable, the vendor has stated the price is based on what the system is configurated and what it charges the Federal Government. 8.Market Survey (FAR 10): Extensive research by the contracting officer proved that there are no third party sources available for Aperio equipment, maintenance and software. A. Source Sought conducted on 05 May 2011, with a closing date of 09 May 2011 showed no interested vendors in this procurement. 9.Other Considerations: N/A 10.Listing of Sources that expressed, in writing, an interest in the acquisition: N/A U. Statement of Actions to Overcome Barriers to Competition Aperio is the only manfactw:e capable to perform this procurement. The provide no third part' sources for maintenance. 12.
