If the portable toilet can not be satisfactorily repaired then it should be replaced immediately (or on a time agreed by the Corps representative and Contractor representative). 9.Contractor will provide a contact person and telephone number of representative for providing emergency services of portable toilets outside of normal business hours. 10.Due to the possibility of periodic high water conditions, it may be necessary to remove portable toilets to high ground within the vicinity of the spillway. As designated by the Corps representative, the Contractor must relocate designated portable toilets within eight (8) hours notice. 11.Portable toilets will need to be anchored to the ground to prevent them from being blown over by wind. Please Note: "Risk of loss or damage to the portable toilets, and to all materials and supplies provided under this contract, shall remain with the contractor. In no event will the government be liable to contractor or any third party for loss of or damage to any property, supplies, or materials provided under this contract, regardless of the cause of such loss.
