- DEPARTMENT OF VETERANS AFFAIRS Justification and Approval For Other Than Full and Open Competition 1.Contracting Activity: The Department of Veterans Affairs, Network Contracting Activity - 8, VISN 8, San Juan Medical Center. Purchase request is 672-11-3-529-0231. 2.Nature and/or Description of the Action Being Processed: This is a firm fixed price, one time action contract to procure services to provide third party asbestos monitoring and inspection services in The VA Caribbean Healthcare System (VACHS), San Juan, Puerto Rico from a Certified Industrial Hygienist/Company by the American Industrial Hygiene Association (AIHA) 3.Description of Supplies/Services Required to Meet the Agency s Needs: Third party asbestos abatement inspection services on behalf of VACHS in project 672-10-601. On-site analysis of Phase Contrast Microscopy (PCM) air samples collected outside the regulated area is required during asbestos abatement projects in order to ensure that the project area, patients, employees, and visitors will not be adversely affected by the abatement work. This service must be provided by a Certified Industrial Hygienist/Company from the American Industrial Hygiene Association (AIHA). Performance includes throughout abatement work monitoring, inspection, testing and other support services inside around the regulated area (PM & R Pool Repair FCA D ) in accordance with VA Specification Section No. 01569 Part 2.3 and the Occupational Safety and Health Administration (OSHA) requirements. Estimated cost is $25,450.00. 4. Statutory Authority Permitting Other than Full and Open Competition: (X) (1) Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements per FAR 6.302-1; ( ) (2) Unusual and Compelling Urgency per FAR 6.302-2; ( ) (3) Industrial Mobilization, Engineering, Developmental or Research Capability or Expert Services per FAR 6.302-3; ( ) (4) International Agreement per FAR 6.302-4 ( ) (5) Authorized or Required by Statute FAR 6.302-5; ( ) (6) National Security per FAR 6.302-6; ( ) (7) Public Interest per FAR 6.302-7; 5.Demonstration that the Contractor s Unique Qualifications or Nature of the Acquisition Requires the Use of the Authority Cited Above (applicability of authority): Only one responsible source can meet mission needs. On-site/field analysis of PCM air samples can only be conducted by Asbestos Analyst Registry (ARR) board approved analysts that belong to an ARR approved organization. Environmental Health & Safety Services (EH&SS) is the only ARR approved organization in Puerto Rico with ARR board approved analysts. 6.Description of Efforts Made to ensure that offers are solicited from as many potential sources as deemed practicable: Sources Sought Synopsis was issued. Synopsis stated the Governments needs in regards third party asbestos monitoring and inspection services. No company was capable of providing information in regards of the content; moreover, no other company can meet the Government s needs in or outside of Puerto Rico. Such services can only be provided by Certified Industrial Hygienist/Company from the American Industrial Hygiene Association (AIHA) board approved Asbestos Analyst Registry (ARR) analysts. Furthermore, efforts are locally restricted to state and local licensure such as the Environmental Quality Board Permiso General Para el Manejo de Materiales con Contenido de Asbestos as enforced by Local Rule 422 Manejo de Materiales que Contienen Asbestos . 7.Determination by the Contracting Officer that the Anticipated Cost to the Government will be Fair and Reasonable: Anticipated price to The Government is anticipated to be Fair and Reasonable. Determination will be based on Independent Government Estimate and typical market prices. A request for proposal will be issued to the Contractor. Contractor s proposal will be evaluated against the IGE estimated cost. Negotiations will be held, if required, in order to reach a fair and reasonable price for both parties. 8.Description of the Market Research Conducted and the Results, or a Statement of the Reasons Market Research Was Not Conducted: As described in section VI above, market research, in accordance with FAR Part 10, was conducted by synopsis of the proposed acquisition, advising industry of the pending acquisition and soliciting inquiries from interested parties was conducted. EH&SS is the only company in Puerto Rico within the AAR and the appropriate state and local licensure that can meet Government requirements and specifications. 9.Any Other Facts Supporting the Use of Other than Full and Open Competition: Efforts are locally restricted to state and local licensure such as the Environmental Quality Board Permiso General Para el Manejo de Materiales con Contenido de Asbestos as enforced by Local Rule 422 Manejo de Materiales que Contienen Asbestos . 10.Listing of Sources that Expressed, in Writing, an Interest in the Acquisition: See action six (6) above. 11. A Statement of the Actions, if any, the Agency May Take to Remove or Overcome any Barriers to Competition before Making subsequent acquisitions for the supplies or services required: Barriers to overcome competition are restricted due to the fact that companies must meet accreditation by The American Industrial Hygiene Association (AIHA) board approved Asbestos Analyst Registry (ARR) analysts. 12. Requirements Certification: I certify that the requirement outlined in this justification is a bonafide need of the Department of Veterans Affairs and that the supporting data under my cognizance, which are included in the justification, are accurate and complete to the best of my knowledge and belief.
