- FBO ANNOUNCEMENT: PRESOLICITATION NOTICE ACTION CODE: <PRESOL> CLASSIFICATION CODE: 70 - General Purpose Information Technology Equipment SUBJECT: COMSOL Renewal of Support services SOLICITATION NUMBER: NB620020-11-03169 RESPONSE DATE: May 25, 2011 CONTACT POINTS: Chris Ganey, Contract Specialist, 301-975-6205 Chon Son-, Contracting Officer, 301-975-8567 DESCRIPTION: The Department of Commerce, National Institute of Standards and Technology (NIST), intends to negotiate a firm fixed price purchase order, on a sole source basis, with COMSOL, Inc of Burlington, MA for the purchase of a COMSOL renewal of support services under other than full and open competition by the authority of FAR subpart 13.106 -1(b)(1): Only one responsible source and no other supplies or services will satisfy agency requirements. A sole source determination is based on the following: Only COMSOL, Inc can meet our technical requirements. Specifically no other vendor can meet the NIST requirements for: Request is to extend/renew support services, which includes technical support and product upgrades, for COMSOL MULTIPHYSICS software which is used by Physics Lab and CNST scientists. We currently have the following one network and one standalone license for this software, with the following modules AC/DC, RF, Optimization, Matlab LiveLink, Chemical Reaction Engineering and Heat Transfer. Comsol is the software manufacturer and sole distributor so they are the only vendor that can provide maintenance. They do not have resellers. Their maintenance includes phone and website support for troubleshooting software problems and software upgrades. COMSOL, Inc. is the manufacturer and distributor of COMSOL MULTIPHYSICS and the modules. COMSOL renewal of support services meets these requirements and enables NIST to meet its mission requirements. Delivery shall be FOB Destination, Gaithersburg, MD, and be completed by May 31, 2010. The North American Industry Classification System (NAICS) code for this acquisition is 511210, and the size standard is $25.0 million. No solicitation package will be issued. This notice of intent is not a request for competitive quotations; however, interested persons may identify their interest and capability to respond to this requirement. The Government will consider responses received by 12:00 p.m. (EST) on March 25, 2011. Inquiries will only be accepted via email to Christopher.ganey@nist.gov. A determination by the Government not to compete the proposed acquisition based upon responses to this notice is solely within the discretion of the Government. Information received will normally be considered solely for the purpose of determining whether to conduct a competitive procurement in the future.
