DEPARTMENT OF VETERANS AFFAIRS Justification and Approval For Other Than Full and Open Competition 1.Contracting Activity: Department of Veterans Affairs, VISN 1, VA Medical Center, 940 Belmont Street (90C), Brockton, MA 02301. Regarding transaction 523-11-3-7910-1808. 2.Nature and/or Description of the Action Being Processed: This is a request for other than full and open competition for the procurement of surgical custom packs needed for direct patient care for the surgical department at VA Boston. Cardinal Health has a current FSS contract, but these are custom surgical kits required for surgery and are considered an open market procurement. RFQ VA-241-11-RQ-0431 is currently open and was posted to FBO, as an SDVOSB set-aside on March 30, 2011. It is currently still being reviewed for contract award, estimated for Oct 1, 2011 start date. Surgical has an immediate need to receive these sterilized surgical kits for scheduled surgeries from May 20, 2011 through September 30, 2011. The estimates are provided based on past history per the schedule, but cannot be 100% foreseen in the near future. Surgical is requesting an immediate purchase order for the immediate needs of the VA patients while the current RFQ is being finalized for contract award. 3.Description of Supplies/Services Required to Meet the Agency's Needs: Period of Performance May 20, 2011 through September 30, 2011 to obtain the following surgical custom packs for the VA Boston Surgical Department: ITEM NO. Only One Responsible Source (FAR 6.302-1) - Cardinal Health, 120 Raritan Center, Edison, NJ 08818 has been supplying these surgical custom kits (as attached in Attachment A&B) for the past ten years for surgical needs of VA patients. This is a follow-on purchase order for the immediate surgical need, so patient care is not interrupted, as the RFQ has been posted to FBO on March 30, 2011 and is still being reviewed for a contract award estimated for October 1, 2011. The surgical department does not have the personnel or the space to sterilize each one of these surgical custom packs required for scheduled patient surgeries. b. Unusual and Compelling Urgency (FAR 6.302-2, 6.303-2(a)(9)(ii)) - The surgical department has run out of the sterilized custom packs, as required under item 3. There are VA patients that have scheduled surgeries, that would be in critical need if these sterilized supplies were not sent immediately. There cannot be a lapse in supply, while a new contract is being negotiated. The surgical packs, as listed in item 3 are based on actual scheduled surgeries and estimated surgeries from May 20, 2011 through September 30, 2011. 6.Description of Efforts Made to ensure that offers are solicited from as many potential sources as deemed practicable: RFQ VA-241-11-RQ-0431 is currently open and was posted to FBO, as an SDVOSB set-aside on March 30, 2011. It is currently still being reviewed for contract award, estimated for Oct 1, 2011 start date. Surgical has an immediate need to receive these sterilized surgical kits for scheduled surgeries from May 20, 2011 through September 30, 2011. There was a positive response to this RFQ and the responses are currently under contracting review. 7.Determination by the Contracting Officer that the Anticipated Cost to the Government will be Fair and Reasonable: The pricing is considered fair and reasonable due to the past pricing history, per FAR 6.303-2(a)(7). 8.Description of the Market Research Conducted and the Results, or a Statement of the Reasons Market Research Was Not Conducted: As described in Section VI above, market research, in accordance with FAR Part 10, was conducted by synopsis of the proposed acquisition, advising industry of the pending acquisition and soliciting inquiries from interested parties. 9.Any Other Facts Supporting the Use of Other than Full and Open Competition: N/A 10.Listing of Sources that Expressed, in Writing, an Interest in the Acquisition: Refer to Section VI above. 11.A Statement of the Actions, if any, the Agency May Take to Remove or Overcome any Barriers to Competition before Making subsequent acquisitions for the supplies or services required: Refer to Section VI above. 12.Requirements Certification: I certify that the requirement outlined in this justification is a Bona Fide Need of the Department of Veterans Affairs and that the supporting data under my cognizance, which are included in the justification, are accurate and complete to the best of my knowledge and belief.
