The proposed contract is 100% set aside for small businessconcerns. 16. Award will be made only if the offeror, the product/service orthe manufacturer meets qualification requirement at time of award, inaccordance with FAR clause 52.209-1 or 52.209-2. The solicitationidentifies the office where additional information can be obtainedconcerning qualification requirements and is cited in each individualsolicitation. 17. Mandatory Language: Written procedures will be used for this solicitation. Authority: 10U.S.C. 2304(c) (1), Justification: supplies (or Services) required areavailable from only or a limited number of responsible sources(s) and noother type of supplies or services will satisfy agency requirements.The proposed contract action is for supplies and services for which theGovernment intends to solicit and negotiate with only one, or a limitednumber of sources under the authority of FAR 6.302. The solicitationwill identify the office where additional information can be obtainedconcerning qualifications requirements as cited in each individualsolicitation. Note: An Ombudsman has been appointed to hear concernsfrom Offerors or potential Offerors during the proposal developmentphase of this acquisition. The purpose of the Ombudsman is not todiminish the authority of the program director or contracting officer,but to communicate contractor concerns, issues, disagreements, andrecommendations to the appropriate government personnel. Whenrequested, the Ombudsman will maintain strict confidentiality as tosource of the concern. The Ombudsman does not participate in theevaluation of proposals or in the source selection process.
