Description
The National Institute of Standards and Technology (NIST), Acquisition Management Division, on behalf of NIST, Gaithersburg, MD and NIST, Charleston, SC, intends to enter into a sole source purchase order with Linde, LLC of Murray Hill, NJ, for a 120 day purchase order to supply liquid nitrogen to NIST in Gaithersburg, MD and Charleston, SC, under the authority of 41 USC 253(c)(1), Only one responsible source. Liquid nitrogen service is an essential component for the equipment within the NIST laboratories to function and for scientists to conduct experiments. The supply of liquid nitrogen has been identified as an essential requirement. Service must continue without interruption to avoid damage and protect Government property, equipment, data, and samples as well as to avoid work stoppages in the laboratories. A solicitation for a follow-on, five year liquid nitrogen contract, was released on www.fbo.gov on April 1, 2011. Proposals are currently due on May 1, 2011. It is necessary to maintain service until the new contract is awarded. Linde is the incumbent contractor for the current liquid nitrogen requirement. Linde owns two of the ten tanks currently serviced under the existing contract as well as all of the six telemetry units currently in use. Linde has the unique capability to continue service to the Government without duplication of costs associated with installation of rented tanks and telemetry units required for continued use under this short term purchase order. Given the need for continuation of service, award of a purchase order to other than Linde may require a break in service while rented tanks and telemetry units are replaced for this short term purchase order. A service interruption could result in damage to Government property, equipment, data, and samples and is not acceptable. Linde's ability to continue service without interruption and duplication of costs is unique as described herein. The North American Industry Classification System (NAICS) code for this acquisition is 325120, and the size standard is 500 employees. No solicitation package will be issued. This notice of intent is not a request for competitive quotations; however, responses received by April 27, 2011, will be considered by the Government. A determination by the Government not to compete the proposed acquisition based upon responses to this notice is solely within the discretion of the Government. Information received will normally be considered solely for the purpose of determining whether to conduct a competitive procurement.
