Description

Justification for Other than Full and Open Competition 1.Identification of the agency and the contracting activity and specific identification of the document as a "justification for other than full and open competition." Agency:U.S. Department of Veterans Affairs Contracting Activity: VISN 15 Contracting Office 4101 S. 4th Street Traffic way Leavenworth, Kansas 66048 2Nature and/or description of the action being approved. This document sets forth the justification and acceptance approval for one of the exceptions to full and open competition allowed under Federal Acquisition Regulation Part 6.302-1(a)(2). To establish a contract with Nuance Communications, Inc to provide all parts, materials, labor, supervision and technical support necessary to perform all aspects of maintenance, upgrades and service of the Nuance Powerscribe & Dictaphone voice activated dictation system at the VISN 15 Eastern Orbit (St Louis, MO) and Western Orbit (Kansas City, MO) locations through other than full and open competition.. 3.A description of the supplies or services required to meet the agency's needs (including the estimated value). Nuance Communications shall provide remote and 8x5 On-site coverage for hardware and software maintenance, upgrades, and support Contract period is to include a Base Year and two (2) Option Years with an aggregate estimated cost of $333,000.00. 4.An identification of the statutory authority permitting other than full and open competition. The statutory authority permitting other than full and open competition is 41 U.S.C. 253(c)(1). 5.A demonstration that the proposed contractor's unique qualifications or nature of the acquisition requires use of the authority cited. The Powerscribe voice recognition system provides voice dictation for all radiology exam interpretation throughout V15. When this system was originally procured, it was designed and built to provide services specific to the requirements/needs of V15. From the point of procurement, the software as well as hardware components must be maintained by the service provider, Nuance. The specific voice recognition software is proprietary and specific to Nuance and system performance demands that the service provider have expertise and knowledge of all facets of the system to ensure little or no downtime. All of the facilities rely on the system to provide accurate and timely turnaround of radiology exam reports. 6.A description of efforts made to ensure that offers are solicited from as many potential sources as is practicable, including whether a CBD notice was or will be publicized as required by Subpart 5.2 and if not, which exception under 5.202 applies. A notice of intent to award a sole source action will be published FBO. 7.A determination by the contracting officer that the anticipated cost to the Government will be fair and reasonable. This contractor will provide information (i.e. other than cost or pricing data), which could include commercial price lists and prices for similar or the same services provided to other customers, to assist the Contracting Officer in determining if the contractor's proposed price is fair and reasonable for the services to be provided. The Contracting Officer anticipates the cost of this procurement to be fair and reasonable. 8. A description of the market research conducted (see Part 10) and the results or a statement of the reason market research was not conducted. In accordance with FAR 10.002, market research was conducted to identify any other sources for this maintenance requirement. Market Research conducted of an internet search and a search of GSA an VA Federal Supply Schedule contracts. No existing contracts that include software support for the Powerscribe system were identified. Also, a search of the FBO website was conducted. There were many notices of VHA VISNs and other agencies purchasing this maintenance and they were all issued under the authority of FAR Part 6.302-1. 9.Any other facts to support the use of other than full and open competition. None. 10.A listing of the sources, if any, that expressed, in writing, an interest in the acquisition. None. 11.A statement of actions, if any, the agency may take to remove or overcome any barriers to competition before any subsequent acquisition for the supplies or services required. N/A. 12.Contracting officer certification that the justification is accurate and complete to the best of the contracting officer's knowledge and belief.
