- The Centers for Disease Control and Prevention (CDC) intends to award a firm-fixed price purchase order to FEI Company, 5350 N.E. Dawson Creek Drive, Hillsboro, OR 97124-5793 for the following Line Items 1) TECNAI12BT TEM TECNAI, Service Type 0-5X8X48m Serial Number D283 and 2) AMT Camera. The maintenance agreement will be for a period NTE one (1) year. Line Item (0001) Tecnai 12BT Microscope (1ea); (0002) AMT Camera (1 ea). CDC believes that this requirement can best be provided by only one provider. Only one responsible source and no other sources will satisfy the Agency's requirements. No solicitation is being issued. This notice of intent is not a request for competitive quotes/proposals, however, all responsible sources may submit a capability statement which, if received by the response date, shall be considered by the Agency. A determination by the Government not to open the requirement to competition based upon the responses to this notice is solely within the discretion of the Government. The Government has determined that FEI is the only responsible source for this requirement in accordance with FAR 6.302-1 since repair and maintenance must be supplied directly by FEI Company to avoid invalidation of equipment warranties and/or service agreement coverages. THIS IS A COMBINED SYNOPSIS/SOLICITATION FOR COMMERCIAL ITEMS PREPARED IN ACCORDANCE WITH THE FORMAT IN SUBPART 12.6, AS SUPPLEMENTED WITH ADDITIONAL INFORMATION INCLUDED IN THIS NOTICE. THIS ANNOUNCEMENT CONSTITUTES THE SOLICITATION; A SEPERATE WRITTEN SOLICITATION WILL NOT BE ISSUED. QUOTES ARE NOT BEING REQUESTED. All responsible sources may submit a capability statement, proposal, or quotation, which shall be considered by the Agency. The following provision(s) apply to this acquisition: 52.212-1 Instructions to Offerors - Commercial Items (MAR 2000) applies to this acquisition; 52.223-13 Certification of Toxic Chemical Release Reporting; 52.223-14 Toxic Chemical Release Reporting; 52.232-1 Payments; 52.233-3 Protest After Award; 52.201-1 Definitions; 52.203-5 Covenant Against Contingent Fees; 52.203-7 Anti-Kickback Procedures; 52.204-7 Central Contractor Registration; Contractor must be CCR Registered prior to submitting bid; The clause 52.212-4, Contract Terms & Conditions - Commercial Items (MAY 1999) applies to this acquisition. The following FAR Clauses are hereby added to this clause: 52.247-35 F.O.B. Destination; The clause at 52.212-5 - Contract Terms and Conditions Required to Implement Statutes or Executive Orders - Commercial Items applies to this acquisition. The following clauses listed in paragraph (b) of 52.212-5 apply to this acquisition: (1), (5), (7), (14), (15), (16), (17), (18), (22), (24), (29) and (30). 52.213-3 must be attached to bid. NAICS CODE: 334516, SIZE STANDARD: $6.5MILLION, OFFERORS SHALL INCLUDE A COMPLETED COPY OF THE PROVISION AT 52.212-3, OFFERORS REPRESENTATIONS AND CERTIFICATIONS - COMMERCIAL ITEMS, WITH YOUR QUOTE.
