- Other Than Full and Open Competition. The Air Force plans to procure one (1) year of the Cyphercast Maintenance Support Agreement and one (1) Reinstatement from International Data Casting (IDC). The Government does not own the data rights to the data or software code and cannot reproduce the Cyphercast product. The Justification and Approval supporting Other Than Full and Open Competition: IDC, Inc. is the only provider for maintenance support agreement of the PiSys GBS License and Cyphercast License. These software programs are proprietary to IDC. No other companies have the ability to provide maintenance of this system. Irdeto Inc. (the developer of Cyphercast) entered into an agreement with International Data Casting (IDC) in which IDC was granted the exclusive rights to sell and support Cyphercast hardware and PiSys software. PiSys is the software used to support Cyphercast, which is a principal component of the Global Broadcast Service (GBS) system that 309th SMXG is maintaining for the Air Force. The Cyphercast system comprises the following hardware that the PiSys software supports: •Encryptors •Cyphercast software scrambler or Gigacrypt hardware scrambler •Smartcards •M-Crypt or PiSys management systems Cyphercast and its supporting software, PiSys are unique, proprietary satellite audio and video scrambling/descrambling equipment. (End of Justification) Contractor must be authorized to sell the Cyphercast Agreement; verification will be made with the manufacturer. AUTHORITY: 10 U.S.C. 2304 (C)(1), JUSTIFICATION: SUPPLIES REQUIRED ARE FROM ONLY ONE OR A LIMITED NUMBER OF RESPONSIBLE SOURCE(S) AND NO OTHER TYPE OF SUPPLIES WILL SATISFY AGENCY REQUIREMENTS. THE PROPOSED CONTRACT ACTION IS FOR SUPPLIES AND SERVICES FOR WHICH THE GOVERNMENT INTENDS TO SOLICIT AND NEGOTIATE WITH ONLY ONE, OR A LIMITED NUMBER OF SOURCES UNDER THE AUTHORITY OF FAR 6.301-1. INTERESTED PERSONS MAY IDENTIFY THEIR INTEREST AND CAPABILITY TO RESPOND TO THE REQUIREMENT OR SUBMIT PROPOSALS. THIS NOTICE OF INTENT IS NOT A REQUEST FOR COMPETITIVE PROPOSALS. HOWEVER, ALL PROPOSALS RECEIVED PRIOR TO THE CLOSING DATE ON THE SOLICITATION WILL BE CONSIDERED BY THE GOVERNMENT. A DETEMINATION BY THE GOVERNMENT NOT TO COMPETE THIS PROPOSED CONTRACT BASED UPON RESPONSES TO THIS NOTICE IS SOLEY WITHIN THE DISCRETION OF THE GOVERNMENT. INFORMATION RECEIVED WILL NORMALY BE CONSIDERED SOLEY FOR THE PURPOSE OF DETERMINING WHETHER TO CONDUCT A COMPETITIVE PROCUREMENT. SPECIFICATIONS, PLANS, OR DRAWING RELATING TO THE PROCUREMENT DESCRIBED ARE INCOMPLETE OR NOT AVAILABLE AND CANNOT BE FURNISHED BY THE GOVERNMENT. THE GOVERNMENT DOES NOT OWN THE DATA OR RIGHTS TO THE DATA NEEDED TO PURCHASE THIS ITEM FROM ADDITIONAL SOURCES. This is a combined synopsis/solicitation. Offers are due on 17 Mar 2011.
