- (Q1) Reference Q&A 36 and others related to CECOM's plans for NexGen SB awards/partial SB set-asides. Will SB primes awarded NexGen IDIQ contracts be permitted to submit proposals for unrestricted task orders? If the answer to this question is yes, will the SBs have to meet the requirements of FAR 52.219-14 on such tasks? (A1) Only primes awarded under the non-set-aside portion will be permitted to submit proposals for non-set-aside task orders. Only Small Business primes awarded under the set-aside portion will be permitted to submit proposals under the set-aside portion. (Q2) Reference the multiple questions addressing restrictions on teaming arrangements (Q&A 3, Q&A 34, Q&A 73, and Q&A 75). The answers to Questions 3, 34, 73, and 75 all indicate that offerors can propose both as prime and as subs but that any offeror who is awarded a prime contract will not be eligible to participate as a subcontractor. We respectfully suggest that the Government reconsider its position on this matter. Such a restriction may run counter to the Government's best interest for a number of reasons. For example, it limits the ability of small businesses to participate in the NexGen procurement because a SB prime would not be eligible to provide support to a LB prime on unrestricted requirements that it might otherwise be ineligible or incapable of bidding as a prime. In addition, this restriction will almost certainly greatly complicate the evaluation. For example, if Company A submits a proposal with Company B as a subcontractor and cites Company B's experience or past performance, and Company B also submits a winning proposal as a prime contractor, how will the Government take into account in the evaluation the fact that Company B is no longer eligible to serve as Company A's subcontractor without first providing Company A and opportunity to "backfill" the now irrelevant experience or past performance? (A2) Prime Contractors are allowed to be subcontractor under other primes. The vendors may be a subcontractor under multiple primes.
