Description
The Department of Veterans Affairs National Energy Business Center Justification and Approval For SDVOSB Sole-Source Upon the basis of the following justification, a sole-source procurement to a SDVOSB for the proposed contractual action is hereby approved based on the contracting officer's market research. 1.Identification of Agency and Contracting Activity The Department of Veterans Affairs, National Energy Business Center, 4141 Rockside Rd., Seven Hills, Ohio, 44131. 2.Nature/Description of Action This activity proposes to issue an RFP to Lee & Ryan Environmental Consulting, Inc., an SDVOSB, for three (3) separate E85 Fueling Stations, one to be installed at the Clement J Zablocki VA Medical Center, located at 5000 West National Avenue, Milwaukee, WI 53295, one at the Oscar G. Johnson VA Medical Center, located at 325 East H Street, Iron Mountain, MI 49801, and one at the Edward Hines VA Medical Center, located at 5000 S. Fifth Avenue, Hines, IL 60141. There are also options for the fuel stations to be powered with Solar PV and include storage batteries. The government estimate for the base and all options is $833,911.20. 3.Description of Supplies/Services The E85 fueling stations will be 12,000 gallons at Milwaukee, 5,000 gallons at Iron Mountain and 10,000 gallons at Hines, and the contractor shall be responsible for all labor, materials, supplies, equipment, design, site preparation, services, training, lighting, camera(s), landscaping, communications, schematic layout, drawings, instruction, Operation and Maintenance manuals, As Built drawings, permits and zoning processes, design, construction, installation and commissioning. The system shall include the following: A.The fueling station tank shall be double-walled and ballistic proof. The skid shall be anchored to the new concrete foundation. The concrete foundation design shall be prepared and stamped by a structural engineer licensed in the states of Wisconsin and Illinois, respectively. The fuel will be delivered to the storage tank from the fuel transport truck by means of a dedicated remote fuel transfer pump that is integrated to the fueling station. The fueling station pump will supply fuel to the fuel dispenser located in, or adjacent to, the containment area. A Programmable Logic Control (PLC) panel will control the fuel system. B.The fuel tank, pumps, dispensers and related equipment shall be skid mounted and provided as a turn-key system. The contractor shall provide an integrally constructed and fabricated, tested and certified system prior to delivery to the VA site. The tank shall contain a product decal specific to the site. Where required, containment structures shall be constructed of steel-reinforced concrete. C.Provide on-demand, monitoring and reporting of actual fuel consumption, vehicle ID, odometer reading, date of fueling and gallons dispensed. Date of fuel transport shall be included. D.Contractor shall provide a card reader/fuel management system capable of authorizing and recording both fuel and fuel transactions using the Wright Express (WEX) and General Services Administration (GSA) Smart fuel cards processing system. The controller shall be compatible with the GSA controller to assist in the reimbursement for the E85 fuel. The system shall be connected to one or more remote billing services by telephone modem for a high speed line, for the purpose of remotely authorizing, recording, and billing transactions by fuel networks (such as Voyager). The Contractor shall be responsible for setting up the remote billing accounts coordinated by the Contracting Officers Technical Representative (COTR). (See Appendix C) E.The E85 Fueling Station shall include clearance warning signs, where appropriate. 4.Statutory Authority Permitting Other Than Full and Open Competition Authority is authorized pursuant to 38 U.S.C 8127 under PL 109-461, as well as FAR 6.302-5, Authorized by Statute. 5.Demonstration of Contractor's Unique Qualifications Lee & Ryan Environmental Consulting, Inc. is registered and verified in the VIP Database (www.vetbiz.gov), as well as CCR, and has the applicable NAICS code (237120). 6.Publicized Requirements This J&A shall be posted within 14 days after an award is made. 7.Determination of a Fair and Reasonable Cost The determination of a fair and reasonable cost will be accomplished through the comparison of proposed price with the government estimate. 8.Market Survey Lee & Ryan Environmental Consulting, Inc. was recommended to the NEBC by the VISN 12 site energy engineers. A phone interview and email correspondence with a representative of the company, Jessica Simmons-Tower, was completed by the contract specialist in order to ensure their capability to complete this project. 9.Other N/A 10.Actions taken to remove barriers to competition N/A Certification The information contained in this justification for other than full and open competition is certified as accurate and complete to the best of my knowledge and belief.
