- This is a combined synopsis/solicitation/Notice of Intent for commercial items prepared in accordance with the format in Subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; quotations are being requested and a written solicitation will not be issued. The solicitation number for this acquisition is NAID-NOI11053 and is being issued as a Notice of Intent. The incorporated provisions and clauses are those in effect through Federal Acquisition Circular 05-49 dated January 24, 2011. This acquisition will be processed under Simplified Acquisition Procedures (SAP) and is not a small business set-aside. The associated North American Industry Classification System (NAICS) Code 334516, which has a business size standard of 500. The National Institutes of Health, National Institute of Allergy and Infectious Diseases intends to procure, on a sole source basis from BD Biosciences, a one year maintenance service contract agreement for the FACS Aria II cell sorter. BD Biosciences is the only known vendor or manufacturer that is authorized and able to provide certified technical expertise, parts and accessories for the following equipment: Item/Description/Quantity (1) Service Contract for the cell sorter, FACSARIA II Special - no lasers, Serial No. P69500129 (Qty-1) (2) Service Contract for Sapphire 488-100 Blue Laser,Serial No. 5341(Qty-1) (3) Service Contract COHR COMPASS GRN 315M-150 Laser, Serial No. 5342 (Qty-1) (4) Service Contract for Laser COHR Cube 640-40 RED(Qty-1) (5) Service Contract for Laser Violet 405-100, Serial No. 5343 (Qty-1) The contractor shall provide the following maintenance services for one year: Labor, travel expenses and parts Two preventative maintenance inspections to include two preventative maintenance kits Software revisions Unlimited service visits Unlimited telephone support for instruments, reagents and applications Emergency on-site service The following factors are being considered for this requirement (1) price, (2) warranty, (3) technical capability to meet requirement specifications. Place of delivery NIH/NIAID, Rockville, Maryland, 20852. The government will award a fixed price purchase order to the responsible contractor. The following FAR provisions and clauses apply to this acquisition: FAR 52.204-7, Buy American Act-Supplies; FAR 52.212-1, Instructions to Offerors- Commercial Items; FAR 52.212.2, Evaluation-Commercial Items; FAR 52.212.3, Offeror Representations and Certifications -Commercial Items; FAR 52.212-4, Contractor Terms and Conditions -Commercial Items; FAR 52.212-5, Contract Terms and Conditions Required to Implement Statutes or Executive Orders- Commercial Items. Copies of the aforementioned clauses are available upon request by telephone to Ms. Patricia Fields at (301) 402-6471. All responsible sources may submit a bid, proposal, or quotation that will be considered by the agency. Small and disadvantage businesses are encouraged to submit a quotation for this requirement. Offerors must include with their offer a completed copy of the provisions at FAR 52.212-3, Offerors Representations and Certifications - Commercial Items. Offers must be submitted no later than 5:00 PM Eastern Time (ET) February 28, 2011 to Ms. Patricia Fields.
