- Signed and redacted Brand Name Justification and Approval Terms and conditions Requirements and Pricing Schedule This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in of FAR subpart 12.6, using Simplified Acquisition Procedures under the Commercial Test Program of FAR Part 13.5, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; proposals are being requested and a written solicitation will not be issued. Solicitation # ED-FSA-11-R-0006 is issued as a request for quotation (RFQ), and incorporates provisions and clauses in effect through the newest amendment of Federal Acquisition Circular 2005-49, effective January 24, 2011. This solicitation will not be set-aside for small business and is considered a full and open competition after exclusion of sources. The Department of Education, Office of Federal Student Aid (FSA) has a brand- name specific requirement for the renewal of annual software maintenance (SWM) for Oracle Siebel Software (see Attachment 1) that is fully integrated as a customer relationship management (CRM) application into two of FSA's most mission-critical systems. Software maintenance must support the Oracle Siebel Software listed under attachment 1. Period of Performance: The proposed purchase order will consist six (6) total CLINs with a Base and two optional periods. The periods of performance are as follows: CLIN 0001- Base Period- 02/28/2011-09/29/2011 CLIN 0002- Base Period- 02/28/2011-02/27/2012 CLIN 1001- Option Period 1- 09/30/2011-03/30/2012 CLIN 1002- Option Period 1- 02/28/2012- 02/27/2013 CLIN 2001- Option Period 2- 03/31/2012- 09/29/2012 CLIN 2002- Option Period 2- 02/28/2013- 02/27/2014 The provisions at 52.212-1-Instructions to Offerors-Commercial, and 52.212-4- Contract Terms and Conditions-Commercial Items, apply to this acquisition and are incorporated by reference. The provision at 52.212-2- Evaluation-Commercial Items does not apply to this acquisition as offerors will be evaluated on a lowest price, technically acceptable basis. Please include a completed copy of the provision at 52.212-3, Offeror Representations and Certifications-Commercial Items, with any quote provided in repsonse to this soliciation. The clause at 52.212-5, Contract Terms and Conditions Required To Implement Statutes or Executive Orders-Commercial Items, applies to this acquisition and Attachment 2 cites additional FAR clauses in this clause that are applicable to the acquisition. Attachment 2 also provides additional terms and conditions that are specific to the Department of Education and FSA, and are required to be included in this solicitation.
