Description
In accordance with FAR 6.302 and 5.2, this notice advertises the government's intent to award a non-competitive contract to Donald O'Brien for production of eight short films featuring National Park Service (NPS) scientists performing their work in the field. The films will be produced from left-over "B Roll" footage shot during the original contract, awarded two years ago. Donald is the sole owner of the footage, which makes Donald the only source. Refer to justification below. Comments and questions regarding this announcement may be directed to Ed McKee, Contracting Officer, at ed_mckee@nps.gov. All comments received before February 18, 2011 will be considered. JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION for SIMPLIFIED ACQUISITIONS OVER $3,000 AND UP TO $100,000 (See FAR 13.106-1) 1. Nature and/or description of the item/service being procured and its intended use (include the anticipated cost):Non-Competitive award to Donald O'Brien for production of eight short films featuring NPS scientists performing their work in the field. Anticipated project is approximately $15,000. 2. Sole Source Justification rationale (Check one and explain below):__X__Only one responsible source. _____ Urgent and compelling circumstances exist. Include critical delivery or performance dates, and when you became aware of the requirement. Provide a specific statement of the impact on Government operations, financial or otherwise, if the required delivery or performance dates are not met. ______ Other _____________________________________________________ Explain: In 2009, the NPS awarded contract P9504090016 to Donald O'Brien for completion of eight short films featuring NPS scientists working in North Coast & Cascades Network parks. In producing that original group of eight films, Donald retained unused "B Roll" footage, featuring additional personnel interviews, scenic views, and wildlife. The NPS will award a new contract to Donald using the "B Roll" footage to produce another group of eight films. This new group of eight films is considered a follow-on requirement to the original contract because the "B Roll" footage being used is one-of-a-kind, owned by Donald O'Brien, and no other entity, public or private, can access. NPS only wants the final product, the completed eight films. Donald is the only one with access to the footage as the original owner, and therefore is the only source.NPS was extremely satisfied with the quality of the original eight films that Donald produced. Donald O'Brien has the experience, expertise, and capability of producing another group of eight films for the NPS, with minimum cost and effort. No new site visits or additional videography will be required. Donald will produce the new group of films solely from the available "B Roll" footage, of which he retained, and owns. 3. Market Research. Please explain the results or why one was not performed. State whether any other offers were received or anyone expressed interest: The original eight films cost $15,320. The NPS has the unique opportunity, two years later, to procure another group of eight films at roughly the same price. The NPS did not pursue seeking out additional sources because no other vendors have access to Donald's extra, unused "B Roll" footage from the previous contract. Without that, a vendor would need to start from scratch, with all new footage, site visits, field interviews, etc. This would significantly increase cost, and not meet the intent of the project, which is to keep costs at a minimum by using previously shot footage. 4. If this is a determination for sole source, the Contracting Officer certifies:a. Only one source is available, or urgent and compelling circumstances exist. b.
