- INTENT TO SOLE SOURCE The United States Army Medical Acquisition Activity (USAMRAA) intends to negotiate, on a sole source basis, IAW FAR 13.501(1) (ii) under the authority of the test program for commercial items (section 4202 of the Clinger-Cohen Act of 1996), with Meso Scale Diagnostics, LLC, 9238 Gaither Road, Gaithersburg, MD 20877-1420, as the only responsible source that can provide the customized services needed to fulfill this acquisition. This is an existing fixed price contract (W81XWH-10-D-0011) to Mesa Scale Diagnostics, LLC, Gaithersburg, MD to provide obtain Human ProInflammatory 7 and 9-Plex Ultrasensitive Kits (5 plates/kit), MAP Kinase Whole Cell Lysate Kits (5 plates/kit), MAP Kinase (Total Protein) Whole Cell Lysate Kits (5 plates/kit), Phospho-MAPK Whole Cell Lysate Sets, and ELISA Conversion Pack I (uncoated plates) for acquiring data for an ongoing study in the Division. Multiplex Assay Plates. The original ceiling amount on the base year was $50,000.00 with four options years at $75,000.00. A modification is proposed to increase the ceiling amount on the base plus the four one-year options to $200,000 per each year. The original solicitation W81XWH-10-T-0274 was solicited open market on ASFI/FedBixOpps.gov and ended on June 11, 2010, and the one quote was received. The contractor for this action is Mesa Scale Discovery a division of Meso Scale Diagnostics, LLC, 9238 Gaither Road, Gaithersburg, MD 20877. In accordance with FAR 6.302-1(b) (2), "the existence of limited rights in data make the supplies available from only one source". The contractor for this action is Meso Scale Discovery. Meso Scale Discovery is the sole manufacturer of these kits. Only Meso Scale Discovery's kits are guaranteed to work with the Sector Imager 2400 instrument used at USAMRIID. Furthermore, we must continue our study using the Meso Scale Discovery platform in order for our new data to be consistent with the data already collected. All capability statements received by closing of this notification of this synopsis will be considered by the Government. A determination by the Government not to compete based on responses to this notice is solely within the discretion of the Government. Information received will normally be considered solely for the purpose of determining whether to conduct a competitive procurement. Based on the above information, the only technically acceptable system is provided by Meso Scale Diagnostics, LLC.
