Description
JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION As required by FAR 6.302-2 - Unusual and Compelling Urgency 1.Identification of the Agency and the Contracting Activity: Department of Veterans Affairs, VA Medical Center, 5000 W. National Ave. Bldg. 5, Milwaukee, WI 53295 2.Nature and/or description of the action being approved: One month Rental of a Mobile MRI (housed in a mobile coach) on an emergency basis for the Jesse Brown VAMC, Chicago, IL. Procurement will proceed on an emergency basis with Advanced Imaging Management. 3. A Description of Supplies/Services required: The Jesse Brown VAMC requires the one month rental of a Mobile MRI (Siemens Magnetom Symphony 1.5 Tesla MRI Scanner, house in a mobile coach) while the current MRI system is being upgraded. This system is required for continual and uninterrupted direct patient care for approximately 150 MRI exams per day which also include numerous critically ill patients who are not able to be transferred to other facilities for testing. The rental of the Mobile MRI is estimated to cost approximately $55,000.00. 4.Statutory Authority permitting other than full and open competition: FAR 6.302-2(a)(2). The VA's need for the supply is of such an unusual and compelling urgency that the Government would be seriously injured unless VA is permitted to limit the number of sources. (41 U.S.C. 253 (c)(2)). 5.Facilities Unique Qualifications: Unusual and compelling urgency. The Mobile MRI unit must have all of the required hookups, software, and equipment to provide emergent delivery required for uninterrupted direct patient care. The unit must be able to fit into the docking area/parking pad without any upgrades. This is the only cost effective option for the facility to continue uninterrupted MRI exams. Outsourcing MRI procedures will also diminish the standard of care by causing serious delays in order to receive timely diagnoses. 6.Efforts made to ensure that offers are solicited from as many potential sources as is practicable: The Small Purchase Center and Contract Service Center conducted research and concluded there were no viable GSA contracts for the product. 7.Determination by the Contracting Officer that the anticipated cost to the Government will be fair and reasonable: Price was compared and confirmed with the end user for the same or similar type requirements and is comparable. 8.Market survey conducted: The Contract Service Center researched GSA and no vendors were found for this product. Since this is an emergency request, no further market research was conducted. 9.Other facts: None 10.Other sources expressing an interest: None 11.Actions to remove or overcome any barriers to competition: In the future, the station should identify research projects, plan ahead and identify special equipment needs before they become an emergency. 12.Certification: I certify that this justification is accurate and complete to the best of my knowledge. Based upon information received from the station, we concur that it is in the best interest of the government to proceed with the emergency procurement with this firm.
