- The National Institute of Standards and Technology (NIST), intends to negotiate, on a sole source basis, under authority of FAR 13.106-1(b)(1), with Kurt J. Lesker Company in Clairton, PA for the purchase of an additional low-temperature effusion like cell (point source) for depositing organic thin films to create complex spin transporting structures which are required for NIST's organic spintronic research and upgrading the existing vacuum pumping system. Sole Source determination is based on the need to maintain 100 percent compatibility with the existing Kurt J. Lesker Company DSC Series Vacuum system that is currently being manufactured. No other manufacturer has a commercially available system that would be 100 percent compatible with Kurt J. Lesker Company's proprietary design and only Kurt J. Lesker Company has the propriety designs required for the mating hardware required to incorporate the addition of a second cell. Kurt J. Lesker Company is the sole manufacturer and distributor of this equipment. Delivery shall be FOB Destination, Gaithersburg, MD, and is required within 90 days after receipt of order. The North American Industry Classification System (NAICS) code for this acquisition is 334516, and the size standard is 500 employees. No solicitation package will be issued. This notice of intent is not a request for competitive quotations; however, the Government will consider responses received by December 20, 2010 at 3:30 pm EST. A determination by the Government not to compete the proposed acquisition based upon responses to this notice is solely within the discretion of the Government. Information received will normally be considered solely for the purpose of determining whether to conduct a competitive procurement.
