- This is a Special Notice for Information Purposes Only. The National Institute of Standards and Technology (NIST) intends to negotiate, on a sole source basis, in accordance with the guidance in FAR Subpart 13.50 (a)(i) with Bruker AXS INC, 5465 E. Cheryl Parkway, Madison, WI 53711 for the purchase of a standard maintenance agreement for NIST's Quantax System. The vendor of this highly technical scientific instrumentation is the only source with the proprietary knowledge and access to repair parts for the service and maintenance of our current equipment. It is imperative to have the Quantax System at full performance at all times. The Quantax System must provide speed and efficiency of chemical characterization of elements of nanometer spatial scales with major, minor, and trace concentrations in samples, hence the need for a post warranty Standard Coverage Plan. The Standard Coverage Plan needed must provide Labor, travel, Preventative Maintenance, Parts, Phone Support, Software Upgrades, Shipping and Loaner Equipment. The Standard Coverage Plan must consist of three Emergency Visits and one Preventative Maintenance Visit that are scheduled within an annual contract period. The associated North American Industrial Classification System (NAICS) code for this procurement is 334516 with a size standard of 500 employees. No solicitation package will be issued. This notice of intent is not a request for competitive quotations; however, the government will consider responses received by December 10, 2010. A determination by the government not to compete the proposed acquisition based upon responses to the notice is solely within the discretion of the government. Information received will normally be considered soley for the purpose of determining whether to conduct a competitive procurement.
