Description

FAR 6.302-1(a)(2), 41 U.S.C. 253 (c) (1) - ONLY ONE RESPONSIBLE SOURCE AND NO OTHER SUPPLIES OR SERVICES WILL SATISFY AGENCY REQUIREMENTS. Upon the basis of the following justification, the use of other than full and open competition for the proposed contractual action is hereby approved pursuant to the authority of 41 U.S.C. 253(c)(1), and FAR 6.302-1(a)(2), only one responsible source and no other supplies or services will satisfy agency requirements. CONTRACTOR: ST. JUDE MEDICAL INC. 1. Agency and Contracting Activity Identification: The Louis Stokes Cleveland Department of Veterans Affairs Medical Center, (LSCDVAMC) 10000 Brecksville Road, Brecksville, Ohio, 44141, VISN 10 Contracting Activity 90(B). 2. Nature of Acquisition Being Approved: The activity proposes to solicit with St. Jude Medical, Inc., using sole source procurement procedures; to provide the Louis Stokes Cleveland Department Veteran Affairs Medical Center, Wade Park facility's Bioengineering Medical Department (Bio-Med) a two year Preventive Maintenance service agreement. 3. Description of Requirement: The Bio-Medical Department has a requirement to obtain a two year Preventive Maintenance service agreement which includes; all necessary repairs/adjustments, software upgrades and technical literature and bulletins for the department's En-Site 3000 Electrophysiology Mapping System. The equipment supports the Cardiology Electrophysiology Program. This requirement is to allow the Electrophysiology Lab, Cardiology Services to continue to provide medical support to the veterans of The Louis Stokes Cleveland Department Veteran Affairs Medical Center. Total Cost Two (2) Years: $79,000.00. 4. Statutory Authority Permitting Other Than Full and Open Competition: Statutory authority permitting; Other Than Full And Open Competition and Only One Responsible Source: 41 U.S.C. 253(c)(1) and FAR 6.302-1(a)(2) 5. The Nature of the Acquisition Requires Use of the Authority Cited: This is the only authorized company that can provide service maintenance and software upgrades according to OEM specifications. The service company employees' must be factory trained by ST. Jude Medical, S.C., Inc. The mapping system utilizes FDA approved proprietary software algorithms. ST. Jude employees are thoroughly trained in the operation and repair of EnSite 3000 Electrophysiology mapping machines and they are the only company that can provide the necessary services and upgrades for the equipment. 6. A Description of Efforts Made to Ensure That Offers From as Many Potential Sources As Practicable and Whether a Notice Will Be Publicized: This procurement was not competed/synopsized due to "Contractor" has sole propriety rights. 7. Anticipated Cost: The Contracting Officer has determined that the anticipated cost to the Government is fair and reasonable based on comparison on historical procurements. 8. Results of Market Survey: A Market survey was conducted previously utilizing the NAC, GSA and Vet-Biz which resulted with St. Jude Medical Inc., being the sole contractor who is authorized and capable to provide required maintenance services and upgrades. 9. Any Other Facts Supporting the Use of Other Than Full and Open Competition: Other information in support of VA's need to procure services using only one responsible source procedures are as follows: delay in continuation of services would result in additional financial loss to the Government and decrease patient turnaround time. 10. Any Other Interested Sources: There are no other sources that expressed in writing an interest in the acquisition. See Item 6 above. 11. A Statement of the Actions, if any, the Agency May Take To Remove of Overcome Any Barriers to Competition Before Any Subsequent Acquisition is required: Sole source requirement competition would be contingent upon; Bio-Medical companies service maintenance divisions would have to agree to a Joint Venture program. If a joint venture is agreed upon, St. Jude Medical will allow authorized vendors to attend a Biomedical Technical Staff Training Program and allow those vendors to become authorized OEM service providers. St. Jude Medical Inc. would have to authorize additional resellers of their products and allow service companies to purchase parts and materials without attending their factory-training program. 12.
