- The Mine Safety & Health Administration, Beaver, West Virginia, intends to award a sole source contract to Eastman Kodak Company for a maintenance support agreement for the following equipment: NexPress S2500 Press, NXP Glossing Unit, and Kodak I1440 Scanner. Eastman Kodak is the manufacturer and exclusive provider of maintenance services for this equipment. The statutory permitting other than full and open competition is FAR 6.302-1, Only One Responsible Source and No Other Supplies and Services Will Satisfy Agency Requirements. Eastman Kodak is the only manufacturer that provides maintenance support for this equipment. Eastman Kodak does not have any authorized resellers who can provide support for this equipment. Miantenance provided by other than an authorized manufacturer could result in damage to the equipment and non-availability of replacement parts. This could result in MSHA's mission-critical services being unavailable to users. Any firm that believes it can provide the services required is invited to submit a written notification to the Contracting Officer within 5 calendar days from the date of publication of this notice. Supporting evidence must be provided in sufficient detail to demonstrate the firm's ability to provide these services. Information must be sent to Rhonda Sizemore via e-mail utilizing MS Word or.PDF file at sizemore.rhonda@dol.gov. No telephone requests will be accepted. Responses received will be evaluated; however, a determination by the Government not to compete the proposed procurement based upon responses to this notice is solely within the discretion of the Government. If no responses are received, MSHA will proceed with the sole source contract.
