- Justification for Other Than Full and Open Competition The passage of the patient protection affordable care act (PPACA) mandates postponement of the implementation of RUG-IV for one year, until October 1, 2011. It also requires the earlier implementation of two key policy changes, concurrent therapy and the look-back period. Prior to PPACA, these two policies were to be implemented with RUG-IV. In order to comply with these aspects of the PPACA it is necessary to establish an interim RUG known as Hybrid (HR) III. Establishing HR-III will facilitate earlier implementation of the two policies will also serve as a bridging system between the existing RUG-III and delayed Rug- IV. Thus the period of performance for the work needed to address the unusual and compelling urgency is September 29, 2010 through September 30, 2011.
