The U.S. Department of Agriculture is in need of a firm fixed-price indefinite quantity commercial service contract for Waste disposal service at Moore Air base for base year from 1/01/2011 to 09/30/2011 With possible 4 option periods. All pricing to include any and all costs but not limited to: overhead, general and administrative costs, profit, and transportation, permits and licensing. 42 U.S.C. 6962 (Solid Waste Disposal Act) applies to this award. Line 003 will be evaluated on an estimated quantity of 24 ea (for evaluation purposes only) •52.247-21 Contractor Liability for Personal Injury and/or Property Damage. CONTRACTOR LIABILITY FOR PERSONAL INJURY AND/OR PROPERTY DAMAGE (APR 1984) (a) The Contractor assumes responsibility for all damage or injury to persons or property occasioned through the use, maintenance, and operation of the Contractor's vehicles or other property and equipment by, or the action of, the Contractor or the Contractor's employees and agents. (b) The Contractor, at the Contractor's expense, shall maintain adequate public liability and property damage insurance during the continuance of this contract, insuring the Contractor against all claims for injury or damage. (c) The Contractor shall maintain Workers' Compensation and other legally required insurance with respect to the Contractor's own employees and agents. (d) The Government shall in no event be liable or responsible for damage or injury to any person or property occasioned through the use, maintenance, or operation of any vehicle or other property and equipment by, or the action of, the Contractor or the Contractor's employees and agents in performing under this contract, and the Government shall be indemnified and saved harmless against claims for damage or injury in such cases. Each Licensee shall provide to USDA new certification of all insurance, permits and licensing specified within ten (10) days of renewal. USDA must receive at least thirty (30) days advance notice of any canceled, discontinued, or diminished coverage. •SAFETY The contractor shall perform all operations in prudent conscientious, safe and professional manner, the Contractor's personnel and equipment shall comply with applicable federal, state and local laws, safety regulations and procedures. The contractor shall ensure that all its employees perform in a safe manner. All personnel involved in handling solid waste shall be trained for the level of expertise required for the proper performance of this task. •PERMITS The Contractor shall, without any additional cost to the USDA, APHIS,PPQ,RMS, Edinburg, TX, be responsible for obtaining any necessary licenses and permits and complying with any applicable federal, state and local laws, codes, and regulations regarding this requirement. •Past performances will also be considered. - Past performance information, if included as an evaluation factor, must include recent and relevant contracts for the same or similar services. References must include contract numbers, points of contact with telephone numbers and other relevant information. References will not be considered without this information.
