Description
Requirements gathering for an SEC-wide automated litigation hold system. Request for Information (RFI) Requirements gathering for an SEC-wide automated litigation hold system. This announcement is a Request for Information, not a solicitation. The SEC is issuing this RFI to gather information on the capabilities of industry and price estimates for the work outlined in the attached Draft Requirements document. If you are interested in providing information, please review the attachments and send all info. to Lori Lawson. You may include price range estimates. The SEC will consider all responses to this RFI as information only, not offers. All information must be sent via email to Lawsonl@sec.gov by no later than the response deadline. The U.S. Securities and Exchange Commission (SEC) requires a comprehensive review by a contractor with industry standard expertise in e-discovery to gather requirements for an automated Litigation Hold System. Much of the agency’s business is conducted electronically. However, operations are still being migrated from paper-based records to electronic records. The ever increasing amount of Electronically Stored Information (ESI) and the burden of requirements under the Federal Rules of Civil Procedure (FRCP) and the recent case law have made it clear that the SEC needs the ability to automatically identify, preserve, collect and store ESI to facilitate e-discovery, conduct authorized internal investigations, and respond to time-sensitive Congressional inquiries. The SEC seeks information to a)Examine the current business process as it relates to litigation holds. Recommend process improvements based on e-discovery industry standards. b)Assess process to search, identify and collect electronic documents by date, to, from, subject, key words, metadata, and/or hash value. c)Assess process to search for electronic documents, including email attachments, throughout the SEC's electronic infrastructure, that is responsive to specified search criteria, without employee involvement and without disrupting employee use of computers. d)Identify limitations and shortfalls in the current manual procedure to collect ESI e)Assess process to store responsive electronic documents in a forensically- sound container that preserves ESI in its native format without altering metadata while documenting and maintaining a chain of custody via a tracking database. f)Conduct a comprehensive study of litigation hold software packages available in the market and recommend solutions that could potentially meet OGC's requirements.
