Description
JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION 1. Identification of the agency and the contracting activity. VA BOSTON HEALTHCARE SYSTEM Procurement for: Diagnostic Testing for Neurological Disorders *2. Nature and/or description of the action being approved SOLE SOURCE PROCUREMENT FOR: Athena Diagnostics 523-10-2-2765-0055 *3. Description of the supplies or services required to meet the agency's needs (including the estimated value). Estimated Dollar value: $175,000 per year, $15,000 per month at most of the facility listed in statement work. Service will be for base and four option years. Item Description: Various Diagnostic Tests for Neurological Disorders 4. Identification of the statutory authority permitting other than full and open competition. FAR 6.302-1, USC 253(c)(1) Only One Responsible Source, *5. Demonstration that the proposed contractor's unique qualifications or the nature of the acquisition requires use of the authority sited. Athena Diagnostic is the only source providing test for Neurologic disorders as stated in the statement of work for patient care. It has been shown that other companies would have to route testing to Athena Diagnostic for processing. A reviewed was done on Quest Diagnostics Test Menu and ARUP Laboratories on their Federal Supply Schedule and test were not shown on schedule. Quest does not offer these test within the Quest Network. Tests sent through Quest are routed to Athena however; experience in VISN 1 has shown that many specimens were rejected by Athena because Quest was unable to deliver to Athena timely. Due to specimen stability testing must be sent directly to Athena. *6. Description of efforts made to ensure that offers are solicited from as many potential sources as is practicable, including whether a Federal Business Opportunities: FBO Notice was or will be published. A notice will be posted on FBO.. 7. Determination by the contracting officer that the anticipated cost to the Government will be fair and reasonable. Determination was conducted and the anticipated cost to the government is fair and reasonable based on historic data from 2007 to 2009. There has only been about a 9.1% percent increase for all Neurological Disorder testing during this time frame. 8. Description of the market survey conducted (i.e., names, of firms and the date(s) the firms were contacted) and the results or a statement of the reasons a market survey was not conducted. A market survey was conducted and found that all test needed for patient care for the Diagnostic Testing for Neurological Disorders are routed to Athena since they are the one source capable of producing the responses of these test in a timely manner. *9. Any other facts supporting the use of other than full and open competition, such as an explanation why technical data packages, specifications, engineering descriptions, statements of work, or purchase descriptions suitable for full and open competition have not been developed or are not available. None 10. A listing of the sources, if any, that expressed, in writing, an interest in the acquisition. ARUP Laboratories 11. A statement of the actions, if any, the agency may take to remove or overcome any barriers to competition before any subsequent acquisition for the supplies or services required. Contracting Activity will continue to encourage full and open competition whenever possible
