Description
THIS IS A NOTICE OF INTENT, NOT A REQUEST FOR PROPOSALS. A SOLICITATION DOCUMENT WILL NOT BE ISSUED AND PROPOSALS WILL NOT BE REQUESTED. It is the intent of the National Institutes of Health (NIH), National Institute of Aging (NIA) to negotiate/award a purchase order on a noncompetitive basis to Becton-Dickinson and Company, doing business as BD Biosciences, 2350 Qume Drive, San Jose, CA 95131-1807 for a Maintenance Service Agreement. The equipment to be maintained is as follows: Facsaria II Special (No lasers), Customer Material No: 643695, Serial No: P69500053; Lightwave XCYTE 60MW UV LSRS, Customer Material No: 345312, Serial No: No-SerialNo-4026 Laser Cube 405-50C Violet; Customer Material No: 641437, Serial No: No-SerialNo-4027 Coherent Sapphire 488-50 Laser, Customer Material No: 642339, Serial No: No-SerialNo-4028 Module Red Laser 640NM 40 MW, Customer Material No: 642528, Serial No: No-SerialNo-4029 The services to be provided include: unscheduled maintenance calls within 48 hours of being notified of the need for repair by the Government. Unlimited Telephone Support: The contractor shall provide unlimited telephone support for repair maintenance of the equipment during NIH working hours M-F, (8:00am - 5:00pm), excluding federal holidays. Telephone support shall include response to questions about practices, application use and service issues that could be diagnosed and resolved with technical assistance over the telephone. Preventive Maintenance Inspections: Two (2) Preventive Maintenance Inspections to be performed during a twelve-month period, including 2 PM kits. Service Agreement: Includes labor, travel, living expenses and parts coverage including system software and/or software upgrades applicable to customer's current configuration released during the Agreement term. Service does not include consumable items (except preventive maintenance kits as applicable). Replacement Parts and Components: The contractor shall provide all parts required to affect a repair covered under its service obligation, subject to availability. All parts supplied during the warranty period or maintenance service agreement period are warranted against defects in material and workmanship until the expiration date of the term and all service shall be performed in a professional manner. The sole source determination is based on the fact that the service engineers from BD Biosciences are knowledgeable about the FACSAria II Special Order System, capable of diagnosing and repairing problems. Only BD Biosciences service engineers have access to factory parts that are needed for repair problems. These engineers are capable of performing the difficult task of configuring the lasers associated with the main instrument. This service contract is required to provide continuous service of this instrument to Research Investigators whereas downtime of this instrument results in significant losses of productivity and fiscal losses when experiments are lost or postponed due to instrument failure. The warranty provisions on the equipment require that BD Biosciences service and repair the equipment. This acquisition is being conducted under FAR Part 13, Simplified Acquisition Procedures, and is exempt from the requirements of FAR Part 6, Competition Requirements. The North American Industry Classification System (NAICS) Code is 811219, Other Electronic and Precision Equipment Repair and Maintenance. This notice of intent is not a request for competitive proposals. The determination by the Government not to compete the proposed purchase order based upon responses to this notice is solely within the discretion of the Government.
