Description
JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION 1.Identification of (1) the agency (2) the contracting activity. Medical Service/Dermatology, Transaction # 523-10-4-7821-0231 2.Nature and/or description of the action being approved. Sole Source procurement for Medical/Surgical supplies from PHOTOMEDIX. 3.Description of the supplies or services required to meet the agency's needs (including the estimated value). The XTRAC laser will benefit our Veterans with skin disorders such as Psoriasis, Vitiligo, Atopic Dermatitis and other skin conditions. The XTRAC laser is a laser that uses a carefully focused beam of light delivered through a sophisticated fiber-optic delivery system, the XTRAC system is designed to deliver a target therapy to clear unsightly psoriatic skin plaques quickly and effectively. Because it concentrates light on active lesions, XTRAC allows to deliver the high-exposure doses necessary for rapid clearing without risk of damage to healthy skin. In addition, it is very effective for localized plaques and is particularly useful for palms and soles. 4.An identification of the statutory authority permitting other than full and open competition. FAR 6.302-1, USC 253(c)(1) Only One Responsible Source, 5.A demonstration that the proposed contractor's unique qualification or the nature of the acquisition requires use of the authority cited. Equipment is specific to Photo-Medex. They are the only known manufacturer of laser light fiber-optic equipment to treat psoriatic skin plaques. Our Dermatology Service doesn't have any equipment or laser with the capabilities of delivering the targeted therapy as the XTRAC laser. 6.Description of efforts made to ensure that offers are solicited from as many potential sources as is practicable, including whether a FedBizOps notice was or will be published as required by Subpart 5.2 and, if not, which exception under 5.202 applies. A sole source notice will be published in FedBizOps.gov. 7.A determination by the contracting officer that the anticipated cost to the Government will be fair and reasonable. The anticipated cost or price to the government for this contract action is determined to be fair and reasonable. 8.A description of the market research conducted (i.e., names of firms and the date(s) the firms were contacted) and the results or a statement of the reasons a market survey was not conducted. A market survey was conducted by Google search on the internet and publications via Pub Med search. Review of literature, substantiated claim that XTRAC laser is beneficial in treating patients was multiple skin diseases. In particular in the Journal Academy of Dermatology along with other Dermatologic journals there are articles showing that the XTRAC laser is effective to treat Psoriasis, Vitiligo, Atopic Dermatitis and other skin conditions. 9.Any other facts supporting the use of other than full and open competition. This Laser has been approved by the Food and Drug Administration to treat psoriasis since 1997 and to treat vitiligo since 2001. There are no other companies that have the similar Laser technology to treat above mentioned skin conditions. 10. A listing of the sources, if any, that expressed, in writing, an interest in the acquisition. There are no known other companies that carry the XTRAC Laser or make any lasers that will treat the mentioned skin conditions that the XTRAC Laser will. 11. A statement of the actions, if any, the agency may take to remove or overcome any barriers to competition before any subsequent acquisition for the supplies or services required. Contracting Activity will continue to encourage full and open competition whenever possible.
