Description
RECOVERY ACTION. FOR INFORMATIONAL PURPOSES ONLY. DUNS 195194779. This action issued Revision 05 to Work Authorization RA-10-001 under M&O Contract number DE-AC52-06NA25946 which is funded by American Recovery and Rehabilitation Act (ARRA) dollars. This revision incorporated the final Federal Acquisition Regulation (FAR) clauses updated in March 2010 and June 2010 and finalized the funding amount at $9,550,000.00. This includes funding provided as follows: Modification 078 in the amount of $4,700,000; Modification 084 in the amount of $3,200,000; Modification 086 in the amount of $1,400,000 and Modification 091 in the amount of $250,000. These modifications addresses the following work: The ARRA objectives for the Waste Management effort on the Nevada Test Site (NTS) is to support the capability to safely and compliantly receive and dispose 2M ft3 of Low-Level Waste (LLW) and Mixed LLW at the Area 5 Radioactive Waste Management Site at the Nevada Test Site in support of the U.S. Department of Energy Complex in Fiscal Year 2010. Justification: Rationale for using other than a fixed price and/or competitive award: Contract Clause DEAR 970.5243.1, Changes (DEC 2000), of the contract authorizes the Contracting Officer to make changes within the general scope of the Management & Operating (M&O) contract. The work scope being accomplished under the Work Authorization as a result of the receipt of the ARRA funds is within the scope of the contract. The prospects for performing the ARRA scope of work under a firm fixed-price (FFP) contract were evaluated prior issuance of the modification. The work contemplated is highly complex and many variables exist that do not lend themselves to the use of a fixed-price contract (FAR16.601(c)). The National Nuclear Security Administration/Nevada Site Office (NNSA/NSO) has communicated to the M&O contractor that FFP subcontracts shall be utilized to the maximum extent possible in accomplishing the specific tasks executed with ARRA funds.
