Description
JUSTIFICATION AND APPROVAL TO PROCURE USING OTHER THAN FULL AND OPEN COMPETITION 1. Identification of Agency and Contracting Activity. The Department of Veterans Affairs (VA), Veterans Benefits Administration (VBA) New York Regional Office, Vocational Rehabilitation & Employment Division, executes this Justification and Approval (J&A) for Other Than Full and Open Competition. 2. Nature/Description of Action. This activity proposes to negotiate a noncompetitive award (sole source) with Barnes International for the procurement of Rehabilitation Technician Services for the VR&E Veteran Reengagement Project and other projects as requested. 3. Description of Supplies/Services. The proposed total contract cost for the one Base year: $109,200.00. 4. Identification of Statutory Authority. The statutory exception permitting other than full and open competition for this acquisition is 10 U.S.C. 2304(c)(5), Authorized or Required by Statute as implemented by FAR 6.302-5. The applicable statute is PL 109-461, Veterans First Contracting Program. 5. Demonstration of Contractor's Unique Qualifications. Barnes International has specific resources and candidate pool that VR&E needs. Their pool of candidates are not only highly qualified, but have experience with similar types of projects and have prepared similar deliverables. The learning curve would be minimal, which would expedite data collection and receipt of final deliverable. 6. Description of efforts made to ensure offers are solicited from as many potential sources as practicable. This acquisition was not synopsized in the Federal Business Opportunity System pursuant to the exception granted at FAR 5.202(a)(4). 7. Determination of Fair and Reasonable Prices. No award shall be made until the Contracting Officer determines the costs to the Government to be fair and reasonable. This determination will be based on a comparison of the Offeror's price proposal to the Government IGCE, which is based on an average hourly rates from GSA 621-047. 8. Description of Market Survey. N/A. The skill and experience required for this project and the population to receive services for this project is well defined and specialized. As mentioned in the above section, Barnes International has the required personnel retained contractors that will ensure successful completion of this requirement. 9. Other facts supporting the use of other than full and open competition. Clearance: Barnes International Contractors have already cleared their background checks. Time sensitive: The first deliverables this project Management Office are July 2010 as required by the Office of the Secretary, Department of Veteran Affairs. 10. Listing of Interested Sources.
