- The Space and Naval Warfare Center,Charleston, SC, intends to issue a SoleSource award to Hyperformix, Inc underthe authority of 10 U.S.C.2304 (C) andin accordance with FAR 6.302-1 (C). The requirement is for annualmaintenance and support for existingHyperformix enterprise software.Hyperformix is the developer of theexisting system and is the onlycompany with the rights and knowledgeto support the system. This action willbe conducted IAW FAR 12 and FAR 13.This synopsis is published forinformational purposes only and is nota request for competitive offers. Anyinquiries concerning this requirementare to be submitted in writing to theContracting Officer. A determination bythe Government not to compete thisproposed action based on responses tothis notice is solely within the discretionof the Government. This requirement is subject to 52.232-18 AVAILABILITY OF FUNDS (APR1984) Funds are not presently available forthis contract. The Government'sobligation under this contract iscontingent upon the availability ofappropriated funds from whichpayment for contract purposes can bemade. No legal liability on the part ofthe Government for any payment mayarise until funds are made available tothe Contracting Officer for this contractand until the Contractor receives noticeof such availability, to be confirmed inwriting by the Contracting Officer.
