- VETERANS AFFAIRS MEDICAL CENTER JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION FAR 6.302-5, 41 U.S.C. 253(c)(5) 1.The VA Long Beach Network 22 Logistics Office, 5901 East Seventh Street, Long Beach, California, intents to enter into a Contract that will require justification for other than full and open competition. 2.This is a request for approval to issue a Sole Source contract to a Service-Disabled Veteran-Owned Small Business (SDVOSB) under the provisions of Public Law 109-461. 3.Contractor shall furnish all architect/engineering services, management, supervision, labor, transportation, equipments, materials and prepare site for building operations, including demolition and removal of existing structures for project entitled, "B140 Demolish-Remove Underground Storage Tank" as required by drawings and specifications. The estimated value of this contract is $446,881.33. 4.The contract shall be issued under the authority of 41 U.S.C.253(c)(5) permitting other than full and open competition, and per FAR Subpart 6.3, paragraph 6.302-5, Authorized or Required by Statute. In accordance with FAR 6.302 "Circumstances Permitting Other than Full and Open Competition" this statutory authority is cited as justification to award a sole source Service Disabled Veteran Owned Small Business contract valued more than $25,000 (simplified acquisition threshold) and less than $5,000,000 (authority ceiling limit). 5.This action requires the use of the cited authority in meeting the socio-economic goals established for the Department of Veterans Affairs. The proposed contractor (Sand Dollar Construction) meets the statutory criteria, and is registered and listed in the VetBiz registry as a SDVOSB contractor. 6.Competition was not sought for this acquisition. Pursuant to 38 U.S.C. 8127(b), a sole-source set-aside is authorized for acquisitions for an amount more than the Simplified Acquisition Threshold but not exceeding $5,000,000. 7.The anticipated cost is fair and reasonable to the government based on using service estimate. 8.In an effort to support VA's socio-economic goals, the undersigned conducted market surveys (via both VetBiz.com and the Central Contractor Registration web sites) for qualified SDVOSB enterprises. The contracting officer has validated that the contractor is registered and certified in the VA VetBiz.gov database and qualifies as "small" in accordance with federal small business size standards for the applicable North American Industry Classification System (NAICS) code assigned to the procurement. All actions considered, no further effort was made to seek additional sources. 9.The subject project was awarded in accordance with VAAR 819.7007 Sole source awards to service-disabled veteran-owned small business concerns. 10.Not applicable per line #2 above. 11.Not applicable per line #2 above.
