Description
DEPARTMENT OF VETERANS AFFAIRS NETWORK 22 CONTRACTING ACTIVITY JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION FAR 6.302-5, 41 U.S.C. 253 (c) (2) 1. Agency and Contracting Activity Identification: The Network 22 Contracting Activity, 5901 E. 7th Street, Long Beach, California, as requested by the VA Southern Nevada Healthcare System (VASNHS), will enter into a supply contract that requires justification for other than full and open competition. 2. Nature of Acquisition Being Approved: Sole source contractor shall provide Stryker medical equipment to the VASNHS for the Morgue under the terms and conditions of a supply contract. 3. Description of Requirement: VASNHS is requesting a sole source supply contract for medical equipment from Alliant Healthcare Products. Pursuant to 38 U.S.C. § 8127(c) and the provisions of Department of Veterans Affairs Office of Acquisition and Material Management (OA&MM) Public Law 108-183, Veterans Benefits Act of 2003The period of performance is September 27, 2010 through June 30, 2011. The estimated for cost for is $402,548.31. 4. Statutory Authority Permitting Other Than Full and Open Competition: The service is being procured under the authority of 41 U.S.C. 253 FAR Part 6.302-5 Authorized by Statute. 5. The Nature of the Acquisition Requires Use of the Authority Cited: Alliant Healthcare is an authorized distributer of Stryker Medical Equipment and is uniquely qualified based upon the following: (a)They are a responsible contractor based on their performance with previous contracts awarded to medical facilities in VISN 22 and the contracting officer does not expect that two or more service-disabled veteran owned small business owners will submit offers for the contract (Alliant is the only authorized vendor of Stryker). (b)They have products that fully integrate with other medical equipment that the VASNHS has purchased. Furthermore, by purchasing Stryker equipment, the VASNHS can use other Government owned equipment while standardizing the facility as well. The VISUM LED Low Ceiling Dual Surgical Lights and StykerCam (Camera), assists surgeons in monitoring the progress of veteran's health by capturing multiple images while in surgery. The life of the LED absorbs heat (which provides comfort to the patients and surgeons); last longer than conventional bulbs which can burn out during long surgeries. The medical equipment can also send images to other healthcare personnel to monitor patient's progress. Additionally, the other medical products that are being procured (System 6- Heavy Duty Power Components and the Cordless Driver System) has a long battery life and can withstand hours of surgery without being recharged which will prevent complications of veteran surgeries. Furthermore, any delay or a dead battery of medical equipment during surgery would have a negative impact on the health and welfare of the veteran beneficiaries and could lead to death. Alliant Healthcare will assist VA personnel in the installation of equipment on facility grounds. If another contractor installs the equipment, VASNHS runs the risks of building construction damage which can cost more money to the tax payers and delay the VASNHS new hospital opening thereby affecting veterans. 6. A Description of Efforts Made to Ensure That Offers From as Many Potential Sources As Practicable and Whether a Notice Will Be Publicized. See item Number 5 above. A notice will be transmitted to the GPE (FedBizOpps) from September 13, 2010 through September 17, 2010. Similar procurements has been solicited for the VA San Diego, and Long Beach this year and there were no responses. DEPARTMENT OF VETERANS AFFAIRS NETWORK 22 LOGISTICS OFFICE JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION FAR 6.302-5, 41 U.S.C. 253 (c) (2) 7. Anticipated Cost: The anticipated cost should be fair and reasonable to the government based on the using service estimate and past prices paid for similar supplies. VA San Diego and Long Beach are currently procuring a leasing contract for similar equipment. There is no fluctuation in prices as this is the flat equipment rate. 8. Results of Market Survey: Market research information was obtained through the GSA website Alliant Healthcare Products are currently on the Federal Supply Schedule (FSS), but the products requested are not listed on their contract. See Item Number 5 above. 9. Any Other Facts Supporting the Use of Other Than Full and Open Competition: None. See Item Number 6 above. 10. Any Other Interested Sources? There are no other sources that expressed in writing an interest in the service. See Item Number 6. 11. A Statement of the Actions, if any, the Agency May Take To Remove of Overcome Any Barriers to Competition Before Any Subsequent Acquisition is required: The anticipated life of the Government Equipment is estimated to be twenty (20) years. The Government plans to maintain this equipment for the next twenty years to maximize usage of the supplies. In order to overcome barriers to competition, the Government shall research other surgical equipment before the procurement of new equipment. Since the medical equipment is proprietary, overcoming the barriers for competition cannot be realized at this time. 12.
