- This is an approved sole source issued under J&A #10-076 and is a combined synopsis/solicitation pursuant to FAR 13.5, Commercial Test Program for Commercial Items "Section 4202 of the Clinger-Cohen Act of 1996". FISC Jacksonville is procuring on behalf of Trident Refit Facility, various sole source Brand Name Hytorc Tools. The Rationale for Sole Source: The Statutory authority for open market items which permits other than full and open competition is 10 U.S.C. 2304 (c) (1), as implemented by FAR 6.302-1 (c), Sole source for brand name only. Trident Refit Facility, TRF, has an inventory of approximately $1.4 million of Hytorc tools. The tools that are being procured in this requirement need to be interchangeable in all facets with TRF s existing inventory due to the requirement to utilize existing and newly purchased components together at several work sites. This procurement is for additional tool sets to be used in conjunction with the existing inventory. The tools must be completely interchangeable. Hytorc will have no liability for the existing tool inventory, and will void the warranty of existing tools if it determines that their product was used in part or whole with any other hydraulic tool, pneumatic tool or pump not manufactured by, or specifically approved by Hytorc. While most of the existing tools are beyond the one year period for replacement from breakage, Hytorc provides upgrades, inspections, and training for the life of their tools, and that coverage will stop if their tools are used in conjunction with another manufacturer s tooling. Additional repair costs, and possible work stoppage will occur if the parts are not interchangeable. Navy personnel have been trained and have repair parts for Hytorc tools. If other brand name tools from another vendor were purchased, additional training and parts inventory costs will result.
