- Solicitation VA-259-07-RP-0440 A/E Services to Convert to Low Pressure Steam Market Research Determination & Findings Findings: 1.FAR Part 19.502-2 Total small business set-asides, paragraph (b) states, "The contracting officer shall set aside any acquisition over $100,000 for small business participation when there is a reasonable expectation that (1) offers will be obtained from at least two responsible small business concerns offering the products of different small business concerns (but see paragraph (c) of this subsection); and (2) award will be made at fair market prices. Total small business set-asides shall not be made unless such a reasonable expectation exists." 2.Public Law 109-461, Veterans Benefits, Health Care and Information Technology Act of 2006, 38 U.S.C. 8127(d), authorizes the Department of Veterans Affairs to change priorities for contracting preferences placing emphasis on Service Disabled Veteran Owned Small Businesses (SDVOSB) and Veteran Owned Small Businesses (VOSB) in that respective order. 3.In order to be eligible for award under this set aside program, all SDVOSB and VOSB firms must be registered in the VetBiz.gov registry and verified by the Contracting Officer. 4.The Contracting Officer may use the SDVOSB and VOSB set aside if there is a reasonable expectation that offers will be received from two or more eligible concerns and such award can be made at a fair and reasonable price that represents the best value to the Government. 5.FAR Part 36.602-1, A/E Selection Criteria, permits the Contracting Officer to include as part of the selection of an eligible firm for award, the following evaluation criteria: (1) Professional qualifications for satisfactory performance; (2) Specialized experience and technical competence in the type of work required; (3) Capacity to accomplish the work in the required time; (4) Past performance on contracts with Government agencies and private industry in terms of cost control, quality of work, and compliance with performance schedules; (5) Location in the general geographical area of the project and knowledge of the locality of the project; provided, that application of this criterion leaves an appropriate number of qualified firms, given the nature and size of the project. Determination: 1.The Montana Health Care System has a requirement for a qualified A/E Firm for development of project drawings and specifications and construction period services for project 436-11-101, Convert to Low Pressure Steam Phase II. Scope includes design of new structures and converting from high pressure steam to low pressure steam and hot water heating, through construction period services. The estimated value of design services is $250,000. 2.Public Law 109-461 permits competition, after exclusion of sources, among eligible SDVOSB and VOSB firms. To be eligible, a firm must be registered in VetBiz registry. A search of the VetBiz registry, State of Montana, under NAICS Code 541310, Architectural Services, revealed no records that matched the selection criteria of; Montana, VOSB/SDVOSB, 8(a), HubZone, WOSB, or SDB. There were four small businesses / emerging small businesses that were listed under the NAICS code in CCR for the state of Montana. However, none were registered in VetBiz registry. The Emerging Small Businesses (ESB) set-aside requirement does not apply as the estimated cost of this acquisition is above $50,000. The other small businesses in the geographic area either had inadequate healthcare facility design/construction experience or were, in the opinion of the contracting officer, not able to handle the scope and magnitude of this project. Thus, the contracting officer does not have a reasonable expectation of receiving offers from at least two responsible small businesses. 3.P.L. 109-461, states there must be a reasonable expectation of receiving two or more offers with firms that possess the qualifications, experience and technical competence for satisfactory performance. 4.FAR permits the use of geographical area when selecting Architectural Engineering firms. This criterion is a basis for knowledge of the local conditions that may be encountered in design of the project. Additionally, current registration/license from the State in which the project takes place is required and is a good practice that represents the best value to the Government leading to minimal changes or redesign during construction phasing. 5.Based on the above Findings and Determination, it is the decision of the Contracting Officer to issue Solicitation VA-259-07-RP-0440 on a full and open basis as there is insufficient number of small business firms to consider for set-aside.
