Description
MEMORANDUM for the File Brand Name Justification - Stryker ICU Beds Solicitation # VA-259-10-RQ-0290 In accordance with FAR Part 11.105, FAR 6.302-1(c) and VAAR 811.104 (items peculiar to one manufacturer), this memo serves as the justification for soliciting brand name hardware. I.Contracting Activity:Department of Veterans Affairs Rocky Mountain Network Contract Center 4100 E. Mississippi Ave. Suite 600 Glendale, CO 80246 II.Nature and/or description of action being approved: The proposed action is for a firm-fixed price order for the purchase of 2 Stryker ICU Beds and associated equipment to be added to the current inventory of beds for the Patient Care Services. III. Identification of the statutory authority permitting other than full and open competition: The statutory authority permitting other than full and open competition is 41 U.S.C.253(C)(1) as implemented by the Federal Acquisition Regulation (FAR) Subpart 6.302-1(c) "Only one responsible source and no other supplies or services will satisfy agency requirements- Application for brand name descriptions." V.Rationale Supporting Use of Authority Cited Above: This request for additional Stryker ICU beds is to ensure an adequate number of working ICU beds will be available at all times in order to meet the needs of the critically ill veteran. Having the same make and model of our current ICU bed will allow for no additional education. This will not only save time, but will also offer cost savings to the Government. In addition, having bed compatibility will also standardize and promote patient and staff safety. VI. Efforts to Obtain Competition: This action will be synopsized and published in the Government Point of Entry (GPE), FedBizzOpps. VII. Determination by the contracting officer that the anticipated cost to the Government will be fair and reasonable. The Contracting Officer determined that the anticipated cost to the Government will be fair and reasonable based on comparison of pricing with other facilities procuring the same services, and negotiations with the offeror to ensure most advantageous pricing. VIII.Market research: Market research has demonstrated that at this time the identified manufacturer is the sole source for this specific bed. Other companies were found that sell similar products but, none could offer the cost savings that the Stryker bed does. IX. Actions to Increase Competition: In future acquisitions for this requirement, the agency will work with the program office to perform additional market research so that other possible solutions can be considered. If other products become available that meet compatibility requirements with the existing hardware, solicitations for future requirements will utilize "brand name or equal" language, if it is in the Government's best interest to do so. As required by FAR 5.102 (a) (6) the Contracting Officer shall include the brand name justification within the solicitation. X. Any other facts supporting the use of other than full and open competition: None. Should it be determined that VISN 19 has a future requirement for this type service, the Contracting Officer will conduct a market survey to fulfill such requirement.
