- GENERAL SERVICES ADMINISTRATION GREAT LAKES REGION PROPERTY MANAGEMENT DIVISION SOUTHERN ILLINOIS/INDIANA SERVICE CENTER 1. JUSTIFICATION AND APPROVAL FOR OTHER THAN FULL AND OPEN COMPETITION This document constitutes justification and approval for other than full and open competition for the acquisition described herein, under the authority of FAR 6.302-1. It is executed on behalf of GSA, Federal Highway Administration Building, 3250 Executive Park Drive, Springfield, IL. 2. DESCRIPTION OF SUPPLIES OR SERVICES REQUIRED This office proposes to procure by means of other than full and open competition, for electric, water, and sewer utility services. 3. DESCRIPTION OF SUPPLIES OR SERVICES REQUIRED TO MEET THE AGENCY'S NEEDS The work to be performed is for electric, water, and sewer utility services for the period of February 3, 2011 through February 2, 2021 at an annual estimated cost of $26,465.00, and for the total evaluated price of $264,650.00 4. IDENTIFICATION OF STATUTORY AUTHORITY PERMITTING OTHER THAN FULL AND OPEN COMPETITION. A. FAR 6.302-1, Only one responsible source and no other supplies or services will satisfy agency requirements. B. 41 U.S.C. 253(c). 5. DEMONSTRATE THAT THE NATURE OF THE ACQUISITION REQUIRES USE OF THE AUTHORITY CITED. The statutory authority cited is FAR 6.302-1, only one responsible source and no other supplies or services will satisfy agency requirements. City Water Light & Power (CWLP) is the only utility company that can provide this service, and therefore, they are the sole source for these services. 6. DESCRIPTION OF EFFORTS MADE TO ENSURE THAT OFFERS ARE SOLICITED FROM AS MANY POTENTIAL SOURCES AS IS PRACTICABLE The exception is FAR 5.202(a)(5) as this action is for a utility. 7. DETERMINATION BY THE CONTRACTING OFFICER THAT THE ANTICIPATED COST TO THE GOVERNMENT FOR THE PROPOSED ACQUISITION WILL BE FAIR AND REASONABLE CWLP is owned and operated by the City of Springfield, IL. Given the fact that this utility is governed by a municipality, Illinois Commerce Commission regulations do not apply. The city of Springfield, IL regulates policies and regulations to ensure that electric, water, and sewer services are provided in an efficient, reliable, economical, and safe manner to adequately meet the needs of the Springfield residents. 8. DESCRIPTION OF MARKET SURVEY CONDUCTED AND THE RESULTS OR A STATEMENT OF THE REASONS THAT A MARKET SURVEY WAS NOT CONDUCTED None was conducted because this is for a utility. See #7 above. 9. ANY OTHER FACTS SUPPORTING THE USE OF OTHER THAN FULL AND OPEN COMPETITION None. 10. LISTING OF SOURCES THAT EXPRESSED AN INTEREST IN THE PROCUREMENT None since this was not advertised on the Fed Biz OPPS website. 11. STATEMENT OF THE ACTIONS, IF ANY, TO REMOVE OR OVERCOME ANY BARRIERS TO COMPETITION N/A. 12. STATEMENT OF DELIVERY REQUIREMENTS The contract is for a 10-year period from February 3, 2011 through February 2, 2021.
