Description
This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in Subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; proposals are being requested and a written solicitation will not be issued. This solicitation and incorporated provisions and clauses are those in effect through Federal Acquisition Circular 2005-44. This requirement is issued as a Request for Quotation (RFQ). DESCRIPTION 1.0 SCOPE: The Walla Walla District of the US Army Corps of Engineers Agency is committed to promoting and supporting the physical and mental fitness of its employees. This Performance Work Statement (PWS) provides for Organizational Memberships in qualified fitness facilities to promote physical fitness for civilian employees with the Agency. 2.0STANDARDS: 2.1 Contractor shall conform to all applicable regulations. 2.2 Contractor shall maintain all required commercial licenses and permits in accordance with customary commercial business practices. 3.0REQUIREMENT: 3.1Organization Membership: The Commander of the Agency has authorized participation in the Fitness and Health Program for civilian personnel within the Walla Walla District, to include the following communities of Waitsburg, Washington; Orofino, Idaho; Coeur dAlene, Idaho; Idaho Falls, Idaho; and Boise, Idaho, all outside of the commuting area of the Walla Walla District Office. The Contractor shall provide all fitness facilities, equipment, locker areas, showers, and membership privileges to civilian employees of the Agency. Participation will vary on location of fitness facilities. See Participation below. 3.2 Period of Performance: The Agency intends to award up to 5 contracts to cover a 1-year period of performance to include four additional optional year periods that may be exercised at the discretion of the Agency. In the event the Agency exercises additional option years, a modification will be executed to incorporate the new period of performance. 3.2Prorated Memberships: Organizational membership fees shall be determined by prorating fees for each employee participant beginning with the month the employee joins the Contractors facility through the end of the employees participation. Organizational memberships shall be on a month-to-month basis. The Agency will not be responsible for annual membership contracts entered into by the participants, any annual renewals of membership contracts, cancellation fees, or any other fees associated with employee participant memberships. It shall be the responsibility of the Contracting Officers Representative of the Agency to notify the Contractor if an employee leaves employment or otherwise becomes disqualified for fitness services. Upon such notice, the Contractor shall properly reduce reimbursement for that prorated portion. If an employee discontinues their membership, the Contractor shall notify the Contracting Officers Representative. 3.3Payments: The Agency will reimburse the Contractor up to $25.00 per month, not to exceed $300.00 per year for each employee participant. If additional monies are due the Contractor, over and above the payments described in this section, it will be the responsibility of the employee participant to pay the remaining fees. See paragraph 3.7, Invoicing. 3.4Pre-Authorization: All Agency employees shall provide the Contractor a Pre-Authorization Card from the Agency before joining the Fitness Facility. This card will Authorize the Contractor to invoice the Agency for reimbursement of each employee participants prorated fee. 3.5Sale of Memberships: Agency participants are not authorized to sell or transfer their Membership to other Agency employees or any other private party during the period of performance of this contract. The Contractor shall advise the Agency of any attempts to change ownership by Agency employees. 3.7 Invoicing: The Contractor shall submit an original invoice to the Agency on a monthly or quarterly basis. See FAR Clause 52.212-4, Contract Terms and Conditions Commericial Items, subparagraph (g) Invoice. Payments will be made by the Agency directly to the Contractor in arrears. Advance payment is not authorized. The Contractor shall include the employee participants name on each invoice for services billed. 3.8Point of Contact: The Contractor shall provide a single point of contact for all membership orders, service request, and billing questions during regular business hours. 4.0PARTICIPATION: It is anticipated that approximately 2 to 3 civilian employees may participate in fitness facilities within the communities of Coeur dAlene, Idaho and Idaho Falls, Idaho. The community of Waitsburg, Washington may anticipate approximately 7 to 10 civilian employees. The communities of Orofino, Idaho and Boise, Idaho may anticipate approximately 12 civilian employees. The following FAR Clauses are incorporated by full text, as follows: 52.217-8 Option to Extend Services (Nov 1999) The Government may require continued performance of any services within the limits and at the rates specified in the contract. These rates may be adjusted only as a result of revisions to prevailing labor rates provided by the Secretary of Labor. The option provision may be exercised more than once, but the total extension of performance hereunder shall not exceed 6 months. The Contracting Officer may exercise the option by written notice to the Contractor within 30 calendar days prior to expiration. (End of clause) 52.217-9 Option to Extend the Term of the Contract (Mar 2000) (a) The Government may extend the term of this contract by written notice to the Contractor within 30 calendar days; provided that the Government gives the Contractor a preliminary written notice of its intent to extend at least 60 days before the contract expires. The preliminary notice does not commit the Government to an extension. (b) If the Government exercises this option, the extended contract shall be considered to include this option clause. (c) The total duration of this contract, including the exercise of any options under this clause, shall not exceed 5 years. 52.222-42 Statement of Equivalent Rates for Federal Hires (May 1989) In compliance with the Service Contract Act of 1965, as amended, and the regulations of the Secretary of Labor (29 CFR Part 4), this clause identifies the classes of service employees expected to be employed under the contract and states the wages and fringe benefits payable to each if they were employed by the contracting agency subject to the provisions of 5 U.S.C 5341 or 5332. Two Wage Determinations are enclosed as uploaded attachments. One of the proposed fitness center locations is Waitsburg, Washington (Walla Walla County).
