- The Naval Medical Logistics Command intends to negotiate on a sole source basis (IAW FAR 13.501) with EMC Corporation 8444 WestPark Drive, McClean, VA 22102, as the only responsible source that can provide maintenance EMC2. Our Command currently uses EMC Storage Area Network SANsystems (2 each) which have already been incorporated into our Network Infrastructure and part ofour Authority to Operate (ATO) accreditation. The initial purchase included three years ofEMC warranty ofspecify special hardware and software support that can only be provided directly from EMC manufacturer technical teams. EMC equipment is a DoD recommended brand that is used by Navy for its network security features. Part ofthis security level is its Certification ofNet-worthiness that is granted by DoD Engineers and certification authority. In order to maintain this certification, only EMC authorized repair technicians are capable ofrepairing EMC devices. The current requirement extends the previous level ofEMC support warranty to a new end-date of29 Sep 2011. The Brand Name ofEMC is a critical factor for extending the current warranty level oftechnical EMC support; EMC is the only source ofproviding this level ofservice for thei own products. The original vendor who provided the hardware (CDW-G) was awarded this contractfor Hardware and Warranty. CD W-G was an authorized reseller ofthe hardware, but had to gain the warranty directly from EM. Numerous other vendors can [similarly] supply the hardware but all must obtain a warranty agreement directly with the EMC manufacturer. The purpose ofthe Sole Source Justification (for EMC) is to retainlcontinue existing level EMC support warranty (directly through EMC) because no other vendor is capable ofproviding this service. NO new hardware is required in this FY10 requirement (therefore an authorized reseller other than EMC is not required). This acquisition is being conducted under simplified acquisition procedures FAR 13.501 under the authority of the test program for commercial items (section 4202 of the Clinger-Cohen Act of 1996). There are not set-aside restrictions for this requirement. The intended procurement will be classified under North America Industry Classification System (NAICS) 541519 with a Small Business Size Standard of 500. This notice of intent is not a request for competitive proposals and no solicitation document exists for this requirement. However, parties interested in responding to this notice will need to submit technical data, including cost, sufficient to determine capability in providing the same product. All capability statements received by the closing date of this synopsis will be considered by the Government. A determination by the Government not to compete based on responses to this notice is solely within the discretion of the Government. Information received will be considered solely for the purpose of determining whether to conduct a competitive procurement.
