Description
This contract action was accomplished using other than competitive procedures because there is only one responsible source due to a unique capability provided, and no other supplies or services will satisfy agency requirements (FAR 6.302-1). See posted J&A for further information. JUSTIFICATION & APPROVAL FOR OTHER THAN FULL AND OPEN COMPETITION 1. Agency and Contracting Activity (FAR 6.303-2(a)(1) a.The agency is Army Corps of Engineers, Omaha, NE. b.The Contracting Agency is the Army Corps of Engineers/NWO-M, Omaha, NE. 2. Nature and/or description of the action being approved (FAR 6.303-2(a)(2)) Request approval to use other than full and open competition procedures to award a sole source purchase order to Protection Engineering Consultants (PEC), a small business. They will provide a security Engineering Class instructor for a class to be held at Camp Julien, Afghanistan in September 2010. 3. Supplies or services required to meet the Agency needs (including estimated value) (FAR 6.303-2(a)(3)) a. PEC will provide a Security Engineering Class instructor to accomplish the following: 1.The instructor will review the Security Engineering Class material to ensure that he is up to date on the most recent class revisions and developments. The instructor shall be knowledgeable of all in course material and possess skills in power point presentations. This course covers the information contained in UFC 4-020-01, Security Engineering Planning Manual and TM 5-853-2/AFMAN 32-1071, Vol. 2, Security Engineering - Concept Design. 2.The instructor will go through pre-deployment training prior to deploying to Afghanistan. 3.The instructor will travel to Camp Julien, Afghanistan. 4.The instructor will provide 40 hours of security engineering classroom instruction. b. This effort will consist of a three phases: review of class materials, deployment training and providing classroom instruction. c. The contract type will be Firm-Fixed Price. The estimated contract value is $35,000 4. Statutory authority (FAR 8.405-6) Authority for the use of other than full and open competition, based on only one responsible source known and where no other supplies or services are able to satisfy agency requirements, is found at 10 USC 2304(c)(1), as implemented by FAR 6.302-1. 5. The proposed contractors unique qualifications require use of the authority cited above (FAR 6.303-2(a)(5) The Security Engineering Class must be taught in September 2010 and the Protective Design Center (PDC) does not have the resources to support this mission in-house. Therefore, the PDC must utilize contract support. Protective Engineering Consultants, LLC has the required experience for this class. Their personnel helped develop the class materials, are experienced in teaching in the class in the CONUS and have traveled to war zones (Iraq) on previous occasions in support of the USACE. Any other consultants would have a steep learning curve to obtain the requisite knowledge not to mention the undetermined time needed to achieve the level of expertise required to teach the class. 6. Description of efforts to ensure that offers are solicited from as many potential sources as practicable (FAR 6.303-2(a)(6)) FAR 5.202 Exception, see item 4 above. Posted on FED Biz Ops dated July 12, 2010 7. Determination of fair and reasonable cost (FAR 6.303-2(a)(7)) The Government anticipates the price paid for the services will be considered fair and reasonable based on verification of labor categories and rates of similar consulting firms. In order to determine a reasonable level of effort, the proposed hours will be technically reviewed by the PDC office. As available, historical information from previously awarded contracts will also be used. 8. Market survey (FAR 6.303-2(a)(8)) Posted on Fed Biz Ops, July 12, 2010, with one response. A capability package was requested, received and evaluated by the Protective Design Center. ResoluteCM, LLC demonstrated design-build experience for physical security at electrical power plants and distribution systems in Iraq. However, it didnt address security engineering teaching experience. 9. Other facts supporting the use of other than full and open competition (FAR 6.303-2(a)(9)) PEC has the experience required to fulfill the need for an instructor on short notice. The schedule requires the class be taught in September 2010. In addition, the cost of developing a new source would likely exceed the $35,000 estimated value of this effort. 10. List of sources, if any, that expressed a written interest in the acquisition (FAR 6.303-2(a)(10)) One response from ResoluteCM, LLC. 11. Actions, if any, that are being taken to remove and overcome barriers to competition before subsequent acquisitions for the supplies or services required (FAR 6.303-2(a)(11) The PDC has initiated an effort (Sources Sought W9128F-10-S-M009 posted July 14, 2010) to acquire a worldwide contract for engineering and consulting services, including security engineering class instructors. 12.
