TITLE: Intent to Sole Source Public Service Announcement data NAICS: 541910 FSC CODE: R499 - Other Professional Services POP STATE: September 1, 2010 - August 31, 2011 AGENCY: VA Center for Acquisition Innovation (CAI); ADDRESS: 7485 New Horizon Way, Frederick, MD 21703 POC: Lee Oliver (202)-461-0585 DESCRIPTION: VA Center for Acquisition Innovations Frederick intends to procure a sole source requirement with The Nielson Company (US), LLC, 770 Broadway, New York, NY 10003 to procure backlog data and current data for the Suicide prevention public service announcement. The purpose of this effort is for the Department of Veterans Affairs (VA), OALC to enter into a sole source contract with The Nielson Company to retrieve data supporting theTV population reach of the suicide prevention public service ads. NAICS Code 541910, Size Standard $7 million applies to this procurement. The proposed contract action is for supplies or services for which the Government intends to solicit and negotiate with only one source under the authority of FAR 6.302-1. Interested persons may identify their interest and capability to respond to the requirement. This notice of intent is not a request for quotations. Interested parties who believe they can meet this requirement must submit information about their capabilities no later than 4:00 PM EST, 11 September 2009 to Lee Oliver (202)-461-0585, lee.oliver@va.gov. All information shall be furnished at no cost or obligation to the Government. This award will be made using simplified acquisition procedures. No solicitation will be made available. Information received will normally be considered solely for the purpose of determining whether to conduct a competitive procurement. A determination by the Government not to compete this proposed contract based upon responses to this notice is solely within the discretion of the Government. Telephone inquiries will not be accepted JUSTIFICATION AND APPROVAL FOR OTHER THAN FULL AND OPEN COMPETITION 1. Contracting Activity: Department of Veterans Affairs (VA), Office of Acquisition, Logistics (OALC) and Construction, 810 Vermont Ave NW Washington DC 20420-0002. 2. Nature of Action Being Approved: The CAI Frederick intends to negotiate a sole source requirement with The Nielsen Company 770 Broadway, New York, NY 10003. This requirement is to procure tracking, audience numbers and dollar value for the Gary Sinisi Suicide Prevention Public Service Announcement (PSA). 3. Description of Services: The purpose of this effort is for the Department of Veterans Affairs (VA), Office of Public and Intergovernmental Affairs (OPIA) to enter into a sole source contract with The Nielson Company to establish a service agreement. The service agreement allows monitoring of Gary Sinisi PSA as well as deomographic data. The total estimated value of this procurement is $29,000.00 4. Statutory Authority: The statutory authority permitting other than full and open competition is 41 U.S.C. 253(c) (1), as implemented by the Federal Acquisition Regulation (FAR) Subpart 6.302-1 entitled, "Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements." 5. Rationale Supporting Use of Authority Cited Above: Nielson's a global leader in measurement and information. They provide a complete view of what consumers watch and buy through powerful insights that clarify the relationship between content and commerce. Whether their clients are in media, consumer packaged goods, telecom or advertising, their expansive data and measurement capabilities provide market context and confidence through a long history of innovation and integrity. 6. Efforts to Solicit Potential Sources: Only one responsible source can perform this unique service for VA. The Neilson Company previously performed comprehensive commercial detection and monitoring in all 210 US television markets for VA during its Suicide Prevention campaign. The service logged the duration and frequency of the Department's Suicide Prevention Public Service Announcements. Recently, VHA identified the need to extend the duration of tracking for the PSAs from January 2010 to May 2010; however, the Nielson contract had already expired. The Neilson company has the capability to recover the data requested by the Department. Since they originally performed the service, Neilson is the only source which can provide the data. 7. Determination of Fair and Reasonable Cost: No award shall be made until the Contracting Officer determines the costs to the Government to be fair and reasonable. This determination will be based on a comparison of the Independent Government Cost Estimate and previous awards made to the Nielson Company on similar requirements. 8. Description of the market research conducted: This company is the only source that can provides detailed knowledge and up to date and back data going back to January 2010 regarding the Gary Sinisi PSA. 9. Any other facts supporting the use of other than full and open competition: This service is unique to the VA because of the company's networking opportunities and detailed knowledge in the acquisition field. 10. Other Interested Sources: None. 11. Future Competitive Plans: In the future if this acquisition is needed we will perform market research to see if there are any additional vendors that have the capability to compete. 12.
