- DEPARTMENT OF VETERANS AFFAIRS LOUIS STOKES CLEVELAND VA MEDICAL CENTER VA/VHA VISN 10 10000 Brecksville Road Brecksville, OH 44141-3204 JUSTIFICATION AND APPROVAL TO PROCURE USING OTHER THAN FULL AND OPEN COMPETITION Upon the basis of the following justification, the use of other than full and open competition for the proposed procurement action is authorized pursuant to the authority of 41 U.S.C. 253(c)(1), only one responsible source. JUSTIFICATION 1.Identification of Agency and Contracting Activity. The Louis Stokes Cleveland Department of Veterans Affairs Medical Center, 10000 Brecksville Road, Brecksville, OH 44141-3204, Visn 10 Contracting Activity. 2.Nature/Description of Action. This activity proposes to procure eight (8) Clearcount Sponge Counting System for the Cleveland VAMC's Surgical Department. 3.Description of Supplies/Services. This requirement is to allow the Cleveland VAMC's Surgical Department to track the number of sponges recovered after surgery. This equipment provides safe and effective means of preventing sponges from being left in the patient after surgery. The quoted cost for this equipment is $119,960.00. 4.Identification of Statutory Authority. The statutory authority permitting only one responsible source is 41 U.S.C. 253(c)(1). 5.Rationale in support of citation in Paragraph 4 above: Description of contractor's unique qualifications or the nature of the acquisition requires use of the authority cited: The vendor, Meline Inc., has a proprietary interest, they are the co-owner with the manufacturer (Clearcount) and exclusive distributor of the "Clearcount Sponge Counting System." This system is essential to patient care. 6. Federal Business Opportunities (Fedbizops) Announcement/Potential Sources. This requirement will not be synopsized in accordance with FAR 13.106-1(b)(2); For sole source (including brand name) acquisitions of commercial items in excess of the simplified acquisition threshold conducted pursuant to Subpart 13.5 the requirements at 13.501(a) apply. 7. Determination of a Fair and Reasonable Cost The Contracting Officer has determined that the anticipated cost to the Government will be fair and reasonable, the government price is the same as the commercial market price, in addition, the vendor is offering the government free shipping an estimated $1,100.00 value.
